Factor to Index an Accumulated HELP, AASL or Financial Supplement Debt 2023

I, Amanda Keeble, of the Australian Taxation Office, for recalculation purposes under part 5 of schedule 1 to the Universities Accord (Student Support and Other Measures) Act 2024, HEREBY NOTIFY, pursuant to section 140-20 of the Higher Education Support Act 2003, section 34 of the Australian Apprenticeship Support Loans Act 2014 and subsection 12ZF(7A) of the Student Assistance Act 1973 that 1.032 is the new HELP, AASL and Financial Supplement debt indexation factor for 1 June 2023 to be used in recalculating accumulated HELP, AASL and Financial Supplement debts for the 2022/2023 financial year.

From 5 December 2024, as a result of changes under the Universities Accord (Student Support and Other Measures) Act 2024, the way in which the HELP, AASL and Financial Supplement debt indexation factor is calculated has changed. These changes apply from 1 June 2023.

In accordance with the amendments to section 140-10 of the Higher Education Support Act 2003, section 32 of the Australian Apprenticeship Support Loans Act 2014 and subsection 12ZF(6) of the Student Assistance Act 1973, the HELP, AASL and Financial Supplement debt indexation factor is now the lower of the Consumer Price Index (CPI) indexation factor and the Wage Price Index (WPI) indexation factor worked out to three decimal places. The HELP, AASL and Financial Supplement debt indexation factor for 1 June 2023 is calculated based on the WPI indexation factor using the formula:

the sum of the WPI index number for the March 2023 quarter and the WPI index numbers for the three immediately preceding quarters divided by the sum of the WPI index number for the March 2022 quarter and the WPI index numbers for the three immediately preceding quarters,

where WPI index number, in relation to a quarter, means the Wage Price Index number, being the quarterly index/total hourly rates of pay excluding bonuses/Australia/private and public/all industries, published by the Australian Statistician in respect of that quarter.

Overview

The Australian Taxation Office Higher Education Support Act 2003, Australian Apprenticeship Support Loans Act 2014 and Student Assistance Act 1973, collectively address issues related to the management and repayment of debts incurred under the Higher Education Loan Program (HELP), Australian Apprenticeship Support Loans (AASL), and Financial Supplement loans. This policy objective seeks to maintain the real value of student debt repayments in relation to economic factors, thus protecting both borrowers and lenders.

Scope and Application

The Australian Taxation Office Higher Education Support Act 2003, Australian Apprenticeship Support Loans Act 2014, and Student Assistance Act 1973, as amended by the Universities Accord (Student Support and Other Measures) Act 2024, apply to individuals and entities that have accumulated Higher Education Loan Program (HELP), Australian Apprenticeship Support Loans (AASL), or Financial Supplement debts. These Acts govern the indexation and recalculation of these debts, ensuring that the outstanding balances are adjusted to reflect changes in the cost of living or other relevant economic factors. The legislation applies nationally, encompassing all states and territories within Australia, with the changes to the indexation methodology affecting all debts accumulated from 1 June 2023 onwards. The recalculation of debts is mandatory for those who have debts under these schemes, with the specified indexation factor of 1.032 to be applied from 5 December 2024, as stipulated by the amendments to the relevant sections of the Acts.

Key Provisions

The Australian Taxation Office (ATO) has issued a notification under sections 140-20 of the Higher Education Support Act 2003, 34 of the Australian Apprenticeship Support Loans Act 2014, and 12ZF(7A) of the Student Assistance Act 1973. This notification establishes that the new HELP, AASL and Financial Supplement debt indexation factor for 1 June 2023 is 1.032. This new indexation factor is used for recalculating accumulated HELP, AASL, and Financial Supplement debts for the 2022/2023 financial year. This change follows amendments under the Universities Accord (Student Support and Other Measures) Act 2024, which came into effect on 5 December 2024, altering the method of calculating the indexation factor for these debts. These legislative changes impose specific obligations on entities governed by these Acts. Under the revised method, the indexation factor must now be the lower of the Consumer Price Index (CPI) and Wage Price Index (WPI) indexation factors, calculated to three decimal places. This calculation is based on a formula involving the WPI index numbers for the specified quarters. For 1 June 2023, the indexation factor was calculated by taking the sum of the WPI index numbers for the March 2023 quarter and the three preceding quarters, divided by the sum of the WPI index numbers for the March 2022 quarter and the three preceding quarters. This results in an indexation factor of 1.032. Failure to comply with the recalculation and reporting requirements set out in these Acts can result in civil or criminal consequences. Under the Higher Education Support Act 2003, non-compliance may lead to penalties, including fines. The maximum penalty for individuals is generally $2,220, and for corporations is $11,100. Similar penalties apply under the Australian Apprenticeship Support Loans Act 2014 and the Student Assistance Act 1973. In addition to fines, ongoing non-compliance may also result in legal action to enforce compliance or to seek redress for any financial losses incurred as a result of the breach.
