Overview

Statutory Rules 1956 No. 20, made under the Customs Act 1901-1954 and the Commerce (Trade Descriptions) Act 1905-1950, addresses the need for updating and refining the regulatory framework governing the export of fresh fruit from Australia. Enacted by the Governor-General with the advice of the Federal Executive Council, these regulations aim to enhance the quality control and trade description standards for fresh fruit exports. The policy objective is to ensure that exported fresh fruit meets specified health and quality standards, thereby maintaining Australia's reputation in the international market. These regulations amend the Exports (Fresh Fruit) Regulations to refine definitions, inspection procedures, and trade descriptions, alongside adjustments to inspection fees and packaging specifications to align with current trade practices and quality benchmarks.

Scope and Application

The Statutory Rules 1956 No. 20, made under the Customs Act 1901-1954 and the Commerce (Trade Descriptions) Act 1905-1950, amend the Exports (Fresh Fruit) Regulations, affecting the export of fresh fruit from Australia. These regulations apply to entities and individuals involved in the export of fresh fruit, including producers, packers, and exporters, ensuring that the fruit meets specific quality and grading standards before being shipped overseas. The amendments cover aspects such as the definition of "disease," trade descriptions, inspection fees, and packaging requirements. The scope of these regulations is national, extending across the Commonwealth of Australia, with the aim of maintaining high standards for exported fresh fruit. The regulations include specific exemptions and thresholds for different types of fruit, such as citrus fruits, and allow for the possibility of further amendments through subordinate instruments to adapt to changing conditions and requirements.

Key Provisions

The primary sections of the Statutory Rules 1956 No. 20 (referred to as C1956L00020) pertain to amendments of the Exports (Fresh Fruit) Regulations. Regulation 4 of the Exports (Fresh Fruit) Regulations modifies the definition of "disease" by removing "growth or decay" and replacing it with "or growth" (Section 1). Regulation 12, which concerns the requirements for trade descriptions, is amended to include the insertion of "the name and" after "legible characters," (Section 2). Furthermore, Regulation 32, concerning inspection fees, is updated to change the fee from "Thirteen shilling's" to "Fourteen shillings and sixpence" (Section 3). The Second and Third Schedules of the Exports (Fresh Fruit) Regulations undergo various amendments, including updates to dimensions, conditions for the packing of fruit, and specific criteria for different types of fruit (Sections 4 and 5). The obligations imposed by these regulations on parties involved in the export of fresh fruit include adhering to the updated definitions and requirements concerning the description, inspection, and packing of fruit. Exporters must ensure that their fruit meets the amended criteria for disease, trade descriptions, and packing standards. For instance, they must verify that the fruit is free from certain malformations, the packaging complies with specified dimensions, and the trade descriptions are accurate and complete. Additionally, the inspection fee has been updated, requiring exporters to pay the new rate. There are potential consequences for non-compliance with these regulations. While the document does not explicitly state the penalties for breaches, under the governing acts, breaches of regulations related to customs and trade descriptions could lead to civil or criminal penalties. Such penalties may include fines, imprisonment, or other sanctions as determined by the relevant authorities. The specifics of penalties would depend on the nature and severity of the breach and would be governed by the broader legal framework under which these regulations operate.
