REGULATIONS UNDER THE CUSTOMS ACT 1901-1965 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1950.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901-1965 and the Commerce (Trade Descriptions) Act 1905-1550.

Amendments of the Exports (Fresh Fruit) Regulations†

Third Schedule—Item 1.

1. Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by inserting in the table in sub-paragraph (1.) of paragraph 1 (in the second column), after the word and figures—

the words and figures—

(b) by omitting from the table in sub-paragraph (4.) of paragraph 1 (in the second column) the word and figures—

and inserting in their stead the word and figures—

(c) by inserting in the table of sub-paragraph (4.) of paragraph 1 (in the second column), after the word and figures—

the words and figures—

(d) by omitting the table in sub-paragraph (5.) of paragraph 1 (in the second column) and inserting in its stead the following table:—

(e) by omitting the table in sub-paragraph (6.) of paragraph 1 (in the second column) and inserting in its stead the following table:—

(f) by omitting from the table in sub-paragraph (7.) of paragraph 1 (in the second column) the words and figures—

(g) by inserting in the table in sub-paragraph (8.) of paragraph 1 (in the second column), after the word and figures—

the words and figures—

(h) by inserting after sub-paragraph (8.) of paragraph 1 (in the second column) the following sub-paragraphs:—

“(8a.) For the purposes of this item, the variety Red Delicious consists of the strains Richared, Starking, Starkrimson and such other strains as are approved by the Secretary.

“(8b.) Apples of a strain that may be exported as Red Delicious may be exported under the name Red Delicious or under the name of that strain and, when exported under the name of the strain, the provisions of this item relating to apples of the variety Red Delicious apply to and in relation to the exportation of the apples as if they were exported as Red Delicious apples.

“(8c.) Apples of the variety Red Delicious shall not be exported unless the apples in each container are of the same strain.”;

(i) by omitting from paragraph 2 (in the second column) the words “and King Pippin” and inserting in their stead the words “King Pippin and Worcester Pearmain”; and

(j) by omitting clauses (b) and (c) of sub-paragraph (2.) of paragraph 6 (in the second column) and inserting in their stead the following clauses:—

“(b) fibreboard cartons equipped with trays or equipped with fillers and pads forming individual cells; or

“(c) wooden boxes equipped with trays,”.

Third Schedule—Item I.

2.—(1.) Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting sub-paragraph (5.) of paragraph 7 (in the second column) and inserting in its stead the following sub-paragraph:—

“(5.) The apples shall be protected by the use of packing material on the top, bottom, sides and ends of each box or tray.”.

(2.) This regulation shall come into operation on the first day of January, 1967.

Third Schedule—Item 1.

3. Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting from sub-paragraph (2.) of paragraph 9a (in the second column) the words “varieties Jonathan and” and inserting in their stead the word “variety”; and

(b) by inserting after subparagraph (2.) of that paragraph the following sub-paragraph:—

“(3.) Apples of the variety Jonathan intended for export to the United Kingdom and continent of Europe shall be placed in cool store as soon as possible after packing and shall not be shipped if the temperature of the apples is above 45 degrees Fahrenheit at the time of loading.”.

Third Schedule—Item 2.

4. Item 2 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting paragraph 1 (in the third column) and inserting in its stead the following paragraphs;—

“1. The trade description shall set out the variety or the authorized abbreviation of the variety, of the grapes contained in the box.

“2. For the purposes of the last preceding paragraph, the authorized abbreviation of a variety of grapes specified in the first column of the following table is the abbreviation set out in the second column of that table opposite to the name of that variety:—

and

(b) by omitting from paragraph 2 (in the second column) the words and figures “18.4 degrees Brix” and inserting in their stead the words and figures “16.2 degrees Brix”.

Third Schedule—Item 8.

5.—(1.) Item 8 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting sub-paragraph (5.) of paragraph 2 (in the second column) and inserting in its stead the following sub-paragraph:—

“(5.) The pears shall be protected by the use of packing material on the top, bottom, sides and ends of each box or tray.”.

(2.) This regulation shall come into operation on the first day of January, 1967.
