Overview
Statutory Rules 1965 No. 92, made under the Customs Act 1901-1963 and the Commerce (Trade Descriptions) Act 1905-1950, was introduced to address specific regulatory gaps in the grading and packing requirements for crayfish tails exported from Australia. Enacted by the Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, this legislation aimed to standardise the quality and presentation of crayfish tails in export shipments. The regulation updates the Exports (Fish) Regulations to ensure consistency and clarity in grading, from net weight classifications to packaging requirements, thereby facilitating fair trade practices and maintaining the reputation of Australian seafood products internationally.
Scope and Application
This statutory rule, made under the Customs Act 1901-1963 and the Commerce (Trade Descriptions) Act 1905-1950, pertains specifically to the regulation of exports of fish, with a particular focus on crayfish tails. The regulation applies to entities and persons involved in the export of crayfish tails from Australia, ensuring that they adhere to specified packing standards. These standards dictate that crayfish tails must be uniformly packed in terms of colour and weight within specific grade categories, ranging from Grade A (less than 6 ounces) to Grade G (20 ounces and over). The rule mandates that the grade of the product must be explicitly stated on the packaging, thereby providing clear trade descriptions to consumers and regulatory bodies. The rule is applicable on a national level, governing the entire export process within Australia's jurisdiction. Notably, the regulation does not explicitly exclude any particular entities or industries from its scope, thus broadly affecting all exporters of crayfish tails. The rule extends its application through the amendment of the Exports (Fish) Regulations, thereby integrating these new standards into existing legislative frameworks.
Key Provisions
The primary operative sections of this regulation pertain to the amendments of the Exports (Fish) Regulations, specifically in relation to crayfish tails. Section (a) of the First Schedule amends paragraph 4 of item 1, stipulating that crayfish tails must be packed such that the tails in each container are uniform in colour and within one of the specified grades. These grades are defined based on the net weight of the crayfish tails, ranging from less than 6 ounces for Grade A up to 20 ounces and over for Grade G. Section (b) further amends sub-paragraph (iii) of paragraph 1 in the Third Column of item 1, requiring the grade of the crayfish tails to be specified alongside other details.
The obligations imposed by this regulation are primarily on exporters of crayfish tails. They must ensure that the crayfish tails are packed in accordance with the specified grades, meaning that all tails within a container must fall within the same weight category and exhibit uniform colour. Failure to comply with these packing requirements can result in non-compliance with the regulatory standards set forth by the Customs Act 1901-1963 and the Commerce (Trade Descriptions) Act 1905-1950.
Breaches of this regulation may lead to legal consequences. While the specific offences and penalties are not detailed in the regulation itself, under the broader Acts from which this regulation is derived, non-compliance could potentially result in penalties such as fines or other civil or criminal sanctions. The exact nature and extent of these penalties would depend on the specific provisions of the overarching Acts and any additional regulations or guidelines that may apply.
