Overview
The Export Market Development Grants Regulations (Amendment) 1992 No. 215 were issued under the authority of the Minister for Trade and Overseas Development and amend the Export Market Development Grants Regulations 1974. The primary purpose of these regulations is to streamline and modernise the existing regulatory framework by repealing redundant requirements related to the verification of claims for grants under the Export Market Development Grants Act 1974. Specifically, the amendment removes the necessity for a statutory declaration to verify the truthfulness and correctness of information in grant applications, as the intent behind this verification is sufficiently addressed by the offences outlined in section 39 of the principal Act. The regulations aim to simplify the administrative process for applicants while maintaining the integrity and oversight of the grant application process. These amendments were designed to align the regulations with contemporary administrative practices and reduce bureaucratic hurdles for businesses seeking export market development support.
Scope and Application
The Export Market Development Grants Regulations (Amendment) 1992 No. 215 amends the Export Market Development Grants Regulations under the Export Market Development Grants Act 1974. These regulations apply to entities seeking grants for export market development activities, targeting businesses and organisations aiming to expand their export activities. The regulations have a national reach, operating across Australia as they pertain to the Commonwealth-level Act. They do not explicitly state exclusions or thresholds, but the requirements and offences outlined in the parent Act would govern eligibility and applicability. The regulations extend the scope of the parent Act by clarifying and updating the regulatory framework, ensuring it remains relevant and efficient in supporting export market development initiatives. The amendments involve repealing outdated regulations concerning the verification of claims, which are now adequately addressed by the statutory offences in the Act itself, thus simplifying the grant application process.
Key Provisions
The Export Market Development Grants Regulations (Amendment) 1992 No. 215, issued under the authority of the Minister for Trade and Overseas Development, amends the Export Market Development Grants Regulations 1974. The main operative sections of these Regulations, particularly Regulation 3, repeal a previously existing regulation (Regulation 5) and Schedule 3, both of which pertained to the requirement for a statutory declaration verifying the truthfulness and correctness of information in a claim for a grant under the Export Market Development Grants Act 1974 (s. 39). These provisions are rendered redundant as the intent to ensure the accuracy of claims is now sufficiently addressed by the offences established in section 39 of the Act. Regulation 1 specifies the commencement date of these Regulations, which is 1 July 1992, while Regulation 2 serves as a declaratory provision.
The obligations imposed by these Regulations primarily concern the administration and enforcement of the Export Market Development Grants Act 1974. With the repeal of Regulation 5 and Schedule 3, entities and individuals applying for export market development grants must ensure their claims comply with the Act's requirements without the necessity of a statutory declaration. The primary obligation remains the truthful and accurate presentation of all information required in a grant application, as any misstatements or inaccuracies are now subject to the penalties and offences outlined in section 39 of the Act. The Regulations streamline the application process by removing outdated requirements, thereby reducing administrative burden while maintaining the integrity of the grant application process.
The consequences for breaching the provisions of the Export Market Development Grants Act 1974, as addressed by the amended Regulations, include both civil and criminal penalties. Section 39 of the Act establishes offences related to false or misleading statements made in the context of a grant application. A person who knowingly makes a false or misleading statement in a claim for a grant can be subject to criminal prosecution. The maximum penalty for an individual is a fine of up to 50 penalty units, while a body corporate can be fined up to 250 penalty units. These penalties underscore the importance of compliance and the serious repercussions that can follow from non-compliance with the Act’s requirements.
