Overview

Statutory Rules 1976 No. 131, made under the Export Market Development Grants Act 1974, amends the Export Market Development Grants Regulations to update the list of eligible entities for grants aimed at supporting export market development. Enacted by the Governor-General of the Commonwealth of Australia on the advice of the Federal Executive Council, these regulations adjust the eligibility criteria and the schedule of approved entities. The policy objective is to ensure that the grants support a broader range of agricultural and industrial cooperatives, marketing boards, and other entities involved in export activities, thereby enhancing Australia's competitiveness in international markets. The regulations aim to streamline the application process and expand the scope of entities that can benefit from these grants, reflecting the evolving needs of the export sector.

Scope and Application

The Statutory Rules 1976 No. 131, made under the Export Market Development Grants Act 1974, outlines specific amendments to the Export Market Development Grants Regulations, affecting the verification of claims and the inclusion of additional entities eligible for grants. The regulations apply to various industries and entities involved in export market development within Australia. The amendment removes the previous limitation on the amount of eligible expenditure for grant claims, thereby extending the scope of financial support available under the Act. Additionally, certain regulatory provisions are repealed, and the schedule is updated to include a broader range of eligible entities, such as co-operative marketers, industry associations, and educational institutions. These changes are designed to facilitate broader participation in export market development initiatives by including a wider array of Australian entities. The regulations are applicable across the Commonwealth, ensuring a uniform approach to the administration and application of export market development grants throughout the country.

Key Provisions

The Statutory Rules 1976 No. 131, made under the Export Market Development Grants Act 1974, primarily concern the amendments to the Export Market Development Grants Regulations. Regulation 2 of the amended Regulations alters the verification requirements for claims by removing a specific financial threshold, meaning that all claims, regardless of the amount specified as eligible expenditure, now require verification (Reg. 2). Additionally, Regulation 6 is repealed, removing any previously specified conditions or limitations that it might have included (Reg. 3). The Schedule 1 of the Regulations is also amended by inserting the names of various corporations, co-operatives, and marketing boards into the list, expanding the entities eligible for grants under the Act (Sch. 1). These Regulations impose specific obligations on entities seeking Export Market Development Grants. They must ensure that any claim for a grant is verified, as per the amended Regulation 2, which removes the previous $5,000 threshold, thereby broadening the scope of claims that need verification. Furthermore, with the repeal of Regulation 6, entities must now adhere to the remaining provisions of the Regulations without the constraints previously outlined in Regulation 6. The amendments to Schedule 1 mean that additional entities, including the newly listed corporations and co-operatives, are now eligible to apply for grants, provided they meet the other criteria set out in the Act and Regulations. Breaching the provisions of these Regulations could lead to various consequences. For instance, submitting a claim for a grant without proper verification, in light of the amended Regulation 2, could be considered non-compliance with the statutory requirements. Although the specific penalties for such breaches are not detailed in the provided text, under the general provisions of the Export Market Development Grants Act 1974, penalties could include financial penalties, recovery of the grant, or other civil remedies. The maximum penalties, if applicable, would depend on the specific nature and severity of the breach, as well as any relevant legislative provisions.
