Overview

The Export Market Development Grants Regulations 1981, as amended, were enacted under the Export Market Development Grants Act 1974 to provide regulatory support for the grant system designed to assist Australian exporters in developing new and expanding existing markets. These regulations address the need for clear and consistent application of the grant scheme by detailing the eligibility criteria and procedural requirements for exporters seeking assistance. The amendments, particularly the insertion of "eligible" in clause 7 of Schedule 4, aim to refine and specify the types of provisions that can be supported by the grants, ensuring that funds are allocated efficiently to initiatives that foster export growth. The regulations were made by the Governor-General, acting on the advice of the Federal Executive Council, with the objective of supporting and enhancing Australia's export market development efforts.

Scope and Application

The Export Market Development Grants Regulations, as amended by Statutory Rules 1981 No. 321, pertain to the claims for export market development grants starting from the grant year that began on 1 July 1981, and each subsequent year thereafter. These Regulations are made under the authority of the Export Market Development Grants Act 1974, and they apply to entities or persons seeking to avail themselves of export market development grants. The scope of these Regulations encompasses the provision of eligible grants to support and foster the development of export markets, with specific amendments to Schedule 4 to clarify eligibility criteria. The geographic and jurisdictional reach of these Regulations is national, as they apply across the Commonwealth of Australia, and they are subject to the overarching Export Market Development Grants Act 1974. The Regulations do not specify any exclusions, exemptions, or thresholds within the text itself, but the determination of eligibility for grants would likely be guided by the criteria set out in the Act and any subordinate instruments or guidelines issued thereunder.

Key Provisions

The main operative sections of the Export Market Development Grants Regulations 1981 (Amendment) concern the provision of eligible grants for export market development. Section 41 of Schedule 4 introduces a crucial amendment, specifying that only eligible grants can be provided under the Act. This amendment applies to claims relating to the grant year that began on 1 July 1981 and each subsequent grant year. Essentially, this regulation clarifies the types of grants that are permissible and eligible for consideration under the Export Market Development Grants Act 1974. The obligations and requirements imposed by these regulations are primarily concerned with the eligibility criteria for grants. According to the amendment, applicants must ensure that the grants they seek are deemed "eligible" under the provisions of the Act. This means that any grant application submitted must meet the specific criteria outlined in the amended regulations. The amendment ensures that only those grants that are explicitly defined as eligible can be approved and processed. This requirement helps maintain consistency and fairness in the grant application and approval process. There are no specific offences or penalties outlined in the amendment itself, but any breach of the eligibility criteria or the provisions of the Export Market Development Grants Act 1974 may result in legal consequences. For example, if an ineligible grant is applied for and subsequently approved, this could lead to the revocation of the grant and potential legal action against the applicant or the entity involved. The precise consequences would depend on the nature of the breach and the provisions of the Act, which may include financial penalties, recovery of funds, or other administrative actions. The maximum penalties, if any, would be determined by the relevant provisions of the primary Act.
