Overview

Statutory Rules 1977 No. 14, made under the Export Finance and Insurance Corporation Act 1974, were introduced to amend the Export Finance and Insurance Corporation Regulations. The objective of this legislative instrument was to update the maximum loan amount and repeal certain regulations that were no longer relevant. Enacted by the Governor-General with the advice of the Federal Executive Council, these regulations aim to ensure the continued effectiveness and relevance of the Export Finance and Insurance Corporation's operations. This includes increasing the maximum loan amount to better support Australian exporters, as well as removing outdated regulations and adjusting allowances for Board members serving outside Australia. The intent is to streamline the Corporation’s regulatory framework and facilitate more efficient support for Australian businesses engaged in international trade.

Scope and Application

The Export Finance and Insurance Corporation Regulations, as amended by Statutory Rules 1977 No. 14, apply to entities and individuals involved in transactions related to the Export Finance and Insurance Corporation (EFIC) under the Export Finance and Insurance Corporation Act 1974. These regulations govern the operations of the EFIC, including the maximum amounts of loans that can be issued, which has been updated from $50 million to $151 million. The regulations also address the allowances for service of appointed members of the Board, particularly when their service is outside Australia, and the division classifications for Managing Directors and Deputy Managing Directors. These regulations have a national reach within the Commonwealth of Australia and are applicable to entities and individuals engaged in export finance and insurance activities. The regulations further repeal certain outdated provisions and amend others to reflect current operational needs, thereby extending and restricting the application of the Act through subordinate instruments.

Key Provisions

The primary operative sections of these regulations involve amendments and repeals to the Export Finance and Insurance Corporation Regulations. Specifically, Regulation 12 is amended to increase the maximum amount of loans from $50 million to $151 million (s.1). Additionally, several regulations are repealed, including Regulations 14, 15, 17, 18, and 19 (s.2). Regulation 16 is also amended to change the classification of allowances for service of appointed members of the Board outside Australia from Second Division to First Division, and sub-regulation (2) is omitted entirely (s.3). Finally, Regulation 20 is amended to alter the classification of allowances for service outside Australia for the Managing Director and Deputy Managing Director, and sub-regulation (2) is omitted (s.4). These regulations impose specific obligations on parties and entities governed by the Export Finance and Insurance Corporation Act 1974. The amendments and repeals in Regulation 12 and the subsequent sections adjust the administrative framework concerning the maximum loan amounts and allowances for service outside Australia. These changes necessitate updates to the financial and administrative practices of the Export Finance and Insurance Corporation, ensuring compliance with the new regulatory standards. Failure to comply with the provisions of these regulations may result in legal consequences. Although specific penalties are not detailed in the provided text, breaches of regulations under the Export Finance and Insurance Corporation Act 1974 generally carry significant penalties. These may include fines, imprisonment, or other sanctions as prescribed by the Act or relevant legislation. The exact penalties would depend on the nature and severity of the breach, and any applicable laws would need to be consulted for precise details.
