Part 1—Preliminary

 

1  Name

  This instrument is the Export Control (Wood and Woodchips) (State Codes of Practice) Instrument 2026.

2  Commencement

  This instrument commences the day after it is registered.

3  Authority

  This instrument is made under subsection 2-9(2) of the Export Control (Wood and Woodchips) Rules 2021.

4  Simplified outline for this instrument

This instrument approves amendments (other than minor amendments) of approved codes of practice. The Minister may, by notifiable instrument, approve the code of practice for a State as amended only if subsection 27(3) or (4) of the Export Control (Wood and Woodchips) Rules 2021 applies to the code of practice as amended.

5  Definitions

Note: A number of expressions used in this instrument are defined in the definitions section of the Act or the Rules including the following:

(a) approved code of practice;

(b) code of practice;

(c) State.

  In this instrument:

Act means the Export Control Act 2020.

Rules means the Export Control (Wood and Woodchips) Rules 2021.

Part 2—Approval of amendments to approved codes of practice for States

6  Code of practice for Victoria

  The approved code of practice for Victoria, as amended and set out in the Code of Practice for Timber Production 2014 (Vic.) as in effect on 18 December 2024, is approved under subsection 2-9(2) of the Rules.

  Note 1: At the time this instrument was made the Code of Practice for Timber Production 2014 (Vic.) as in effect on 18 December 2024 was available at: www.forestsandreserves.vic.gov.au

  Note 2: The code of practice for Victoria was approved on 2 May 2013: see Notice of Approval of Plantation Forestry Codes of Practice in New South Wales, Victoria, Western Australia, Tasmania, the Australian Capital Territory and the Northern Territory made under regulation 4B of the Export Control (Unprocessed Wood) Regulations (Commonwealth Gazette Notice C2013G00832). The approval continues in force as if it had been given under subsection 2-7(1) of the Rules (see section 12-1 of the Rules).

7  Code of practice for Tasmania

  The approved code of practice for Tasmania, as amended and set out in the Forest Practices Code (2020) Tasmania (Tas.) as in effect on 30 January 2025, is approved under subsection 2-9(2) of the Rules.

  Note 1: At the time this instrument was made the Forest Practices Code (2020) Tasmania (Tas.) as in effect on 30 January 2025 was available at: https://fpa.tas.gov.au/

  Note 2: The code of practice for Tasmania was approved on 2 May 2013: see Notice of Approval of Plantation Forestry Codes of Practice in New South Wales, Victoria, Western Australia, Tasmania, the Australian Capital Territory and the Northern Territory made under regulation 4B of the Export Control (Unprocessed Wood) Regulations (Commonwealth Gazette Notice C2013G00832). The approval continues in force as if it had been given under subsection 2-7(1) of the Rules (see section 12-1 of the Rules).

8  Code of practice for Northern Territory

  The approved code of practice for the Northern Territory, as amended and set out in Appendix 2 to the Sustainable Forestry Practices – Guidelines for the Northern Territory (2021) (NT) as in effect on 17 February 2025, is approved under subsection 2-9(2) of the Rules.

  Note 1: At the time this instrument was made the Sustainable Forestry Practices – Guidelines for the Northern Territory (2021) (NT) as in effect on 17 February 2025 was available at: https://www.territorynrm.org.au/  

  Note 2: The code of practice for the Northern was approved on 2 May 2013: see Notice of Approval of Plantation Forestry Codes of Practice in New South Wales, Victoria, Western Australia, Tasmania, the Australian Capital Territory and the Northern Territory made under regulation 4B of the Export Control (Unprocessed Wood) Regulations (Commonwealth Gazette Notice C2013G00832).
