EXPORT CONTROL (ORDERS) REGULATIONS

 

Export Control Orders No. 8 of 1987

 

Export Control (Processed Fruits and

Vegetables) Orders

 

I, THE MINISTER OF STATE FOR PRIMARY INDUSTRIES AND ENERGY, hereby make the following Orders under the Export Control (Orders) Regulations.

Citation

1. These Orders may be cited as the Export Control (Processed Fruits and Vegetables) Orders.

 

Repeal of Export Control (Fruits and Vegetables) Orders.

2. The Export Control (Fruits and Vegetables) Orders are repealed.

Application

3.1 These Orders apply to processed fruits and vegetables, which are declared to be prescribed goods for the purposes of the Act.

3.2 Sub-order 3.1 does not extend to

(a) goods that are ships’ stores or aircrafts’ stores, being goods brought into or shipped in Australia for the use of the passengers and crew or for the service of the ship on a voyage, or the aircraft on a flight from Australia;

(b) goods that are not produced, processed or manufactured in Australia;

(c) goods that are imported into Australia and reexported in the same covering and under the same trade description with which they were imported; or

(d) goods that are consigned to an external Territory for consumption within that Territory.

Interpretation

4.1 In these Orders, unless the contrary intention appears, words have the same meaning as in the General Orders except that

“fruit product” means a product one of the major components of which is a fruit or a constituent part of a fruit;

“General Orders” means the Prescribed Goods (General) Orders as amended;

“processed fruits and vegetables” means any fruit or vegetable that has been subjected to thermal processing or freezing, and any fruit product, or vegetable product; and

“vegetable product” means a product one of the major components of which is a vegetable or a constituent part of a vegetable.

4.2 Where reference is made in these Orders to the application to processed fruits and vegetables of a provision in the General Orders, that reference shall be read as if the fruits and vegetables were declared to be prescribed goods under the General Orders.

5. For the purposes of section 7 of the Act, the export of any kind of processed fruits and vegetables is prohibited unless the conditions and restrictions specified in the Schedule in relation to goods of that kind are complied with.

Exemption

6. Part 4 of the General Orders is applicable to processed fruits and vegetables.

Sampling

7. Part 15 of the General Orders is applicable to processed fruits and vegetables.

Delegations

8. Part 19 of the General Orders is applicable to processed fruits and vegetables.

Savings

9. Notwithstanding the repeal of the Export Control (Fruits and Vegetables) Orders every exemption that was granted under a provision of those Orders in respect of processed fruits and vegetables continues in force for the period for which it would have remained if those Orders were still in force and shall be deemed to have been granted for the purposes of these Orders.

SCHEDULE

Trade description

1.1 Except as provided in sub-clause 1.2, the trade description, including embossed symbols on a can, applied to processed fruits and vegetables shall not include the letters ‘Ex’ and followed by a number or any other letter or symbol or combination of letters and symbols which may suggest to the purchaser or to any other person likely to have an interest in the goods that the goods were prepared at a registered establishment, or have been inspected by an authorized officer.

1.2 The Secretary may determine that processed fruits and vegetables prepared at an establishment of a kind specified by the Secretary shall include in the trade description applied to those processed fruits and vegetables a letter or symbol, or a combination of letters and symbols that identifies the establishment at which the processed fruits and vegetables were prepared.
