PROHIBITION OF ENTRY INTO A PETROLEUM GAS SAFETY ZONE

 

 

I, Chris Bourne, a representative of the National Offshore Petroleum Safety and Environmental Management Authority [NOPSEMA], pursuant to section 616 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act), hereby prohibit all vessels other than vessels under the control of Esso Australia Resources Pty Ltd and vessels operated by authorised persons who are exercising powers under Division 5 of Part 6.6 of the above Act from entering or being present in the area of the safety zone without the consent in writing of NOPSEMA. 

 

This petroleum safety zone extends to a distance of 500 metres, measured from each point of the outer edge of the wells in the title areas VIC/L6 and VIC/L20, as described in table 1.

The safety zone will be valid from 21 April 2024 to 31 August 2024.

 

Where an unauthorised vessel enters or remains in the safety zone specified in contravention of this notice, the owner and the person in command or in charge of the vessel are each guilty of an offence against Section 616 of the Act and are punishable, upon conviction, by imprisonment for a term:

  • not exceeding 15 years if the breach is determined as intentional.
  • not exceeding 12.5 years if the breach is determined as recklessness.
  • not exceeding 10 years if the breach is determined as negligence.
  • not exceeding 5 years if the breach is determined as an offence of strict liability.

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a framework for the regulation of offshore petroleum exploration, production, and greenhouse gas storage activities in Australian waters. This legislation was introduced to address the need for stringent safety and environmental management standards in offshore petroleum operations, ensuring that they are conducted in a manner that minimises risks to human health, safety, and the environment. Enacted by the Parliament of Australia, the Act aims to establish a comprehensive regulatory regime that balances the economic benefits of offshore petroleum activities with the imperative to protect marine ecosystems and public safety. The Act empowers the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) to enforce compliance with safety and environmental standards through the issuance of notices, such as the prohibition of entry into designated safety zones around offshore petroleum operations. In response to specific operational needs, NOPSEMA has issued a notice under section 616 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, prohibiting unauthorised vessels from entering a designated petroleum safety zone around the wells in title areas VIC/L6 and VIC/L20. The safety zone extends 500 metres from the outer edge of the wells and is in effect from 21 April 2024 to 31 August 2024. Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) applies to the regulation of petroleum activities and greenhouse gas storage within the Commonwealth of Australia. Specifically, this Act facilitates the establishment of safety zones around petroleum operations to ensure environmental and operational safety. The Act applies to entities such as Esso Australia Resources Pty Ltd, which is responsible for compliance with the Act within designated areas, including VIC/L6 and VIC/L20. The legislation mandates that only vessels under the control of Esso Australia Resources Pty Ltd or those operated by authorised persons exercising powers under Division 5 of Part 6.6 of the Act are permitted to enter the specified safety zones without written consent from the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA). The safety zone, as detailed in the notice, extends to a radius of 500 metres from the outer edges of the wells in the specified title areas and is in effect from 21 April 2024 to 31 August 2024. The penalties vary based on the nature of the breach, with maximum imprisonment terms of up to 15 years for intentional breaches, up to 12.5 years for reckless breaches, up to 10 years for negligent breaches, and up to 5 years for strict liability offences. These stringent penalties underscore the importance of compliance with the safety regulations and the potential legal consequences of non-compliance.
