The Act applies to a broad spectrum of industries, including mining, renewable and non-renewable energy generation, residential development, and water management. Specific actions or activities that require approval under the EPBC Act include those that may impact listed threatened species and communities, listed migratory species, and other matters of national environmental significance. The Act may also apply to actions determined as not requiring approval under certain conditions. The main operative sections, such as sections 75, 87, and 133, define the procedures for determining whether certain actions require approval, the assessment approaches to be used, and the conditions under which approval may be granted. Section 75 specifies that certain actions require approval if they may have a significant impact on matters of national environmental significance, as outlined in sections 18, 18A, 20, and 20A of the Act. Section 87 details the assessment approaches, such as Public Environment Reports or accredited assessment processes, that should be used to evaluate the potential environmental impact of proposed actions. For instance, section 474 outlines criminal penalties for non-compliance, including fines up to $720,000 for individuals and $3.6 million for bodies corporate, along with potential imprisonment. Civil penalties, as stipulated in section 528, can include fines up to $1.1 million for serious or repeated breaches. The Act also allows for the recovery of costs incurred by the Commonwealth in taking enforcement action. Moreover, any person who causes harm to listed threatened species or communities, as defined under sections 18 and 18A, may face additional fines and penalties as specified under section 210.
