Overview

However, the Department acknowledges that some notifications may occasionally be missed and commits to notifying the public even if the timeframe for notification has lapsed. The Department regrets any inconvenience caused by missed notifications and assures that such occurrences do not affect subsequent processing of referrals or assessments and do not impact the decisions made.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a wide range of activities and entities within Australia, including corporations, individuals, and various industries, where actions may impact on matters of national environmental significance. These include World Heritage properties, National Heritage places, wetlands of international significance, listed threatened species and ecological communities, migratory species, the marine environment, the Great Barrier Reef Marine Park, and radioactive substances. The Act operates on a Commonwealth level, providing a national framework for environmental protection and biodiversity conservation, but also allows for state and territory laws and processes to be integrated within its scope. Certain activities may be exempt or subject to thresholds that determine whether they require assessment and approval under the EPBC Act, as evidenced by the listed projects which range from commercial developments to renewable energy initiatives. Section 75 allows for the determination of whether an action requires approval, while section 87 outlines the approach for assessing such actions. Once an assessment is complete, section 133 allows for the approval of actions with conditions. Finally, section 143 provides the mechanism for varying the conditions of an approval. The Act imposes several obligations on parties or entities involved in actions that require approval. These include providing preliminary documentation and responding to referrals for approval (section 75), submitting an Environmental Effects Statement (EES) or equivalent assessment documentation (section 87), and adhering to any conditions attached to an approval (section 133). Under section 528, individuals and corporations found guilty of an offence under the Act can face fines of up to $1.1 million for individuals and $5.5 million for corporations, as well as imprisonment for up to five years for individuals and seven years for corporations. Additionally, section 530 allows for the imposition of penalties for the non-compliance with conditions of an approval, which can include fines up to $66,000 per day for corporations and $13,000 per day for individuals. The seriousness of the offence, the extent of non-compliance, and any previous convictions are considered when determining penalties.
