The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a broad range of entities and activities across Australia, encompassing various industries such as air and space transport, mining, energy generation and supply, and residential and commercial developments. The Act governs actions that may impact matters of national environmental significance, including listed threatened species and communities, listed migratory species, and wetlands of international importance. This Act extends to Commonwealth waters and territories, providing a national framework for environmental protection. Notably, the Act does not apply to certain activities that are subject to state or territory laws or have specific exemptions as outlined in the legislation. Additionally, the EPBC Act allows for the extension or restriction of its application through subordinate instruments, which may provide further detail or specify particular conditions for different types of actions or industries. The recent decisions published under the EPBC Act illustrate its wide application, affecting projects in various states such as the Northern Territory, Western Australia, Queensland, and Victoria. Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) sets out various requirements for activities that may impact on matters of national environmental significance. Recent actions determined under the Act include proposals for the Arnhem Space Centre Operations (Down Range Recovery) in the Northern Territory, Mount Gibson Gold Project in Western Australia, Victoria to New South Wales Interconnector West in Victoria, Double Jump Road Residential Estate Development in Queensland, Berrimah Freight Terminal Expansion Project in the Northern Territory, Rhodes Ridge Iron Ore Project in Western Australia, Northern Terminal to Neerabup Terminal 330kV Transmission Line in Western Australia, and Derrimut Logistics Hub Industrial Development in Victoria, all of which require approval due to potential impacts on listed threatened species and communities, migratory species, and wetlands of international importance (sections 16, 18, 18A, 20, 20A, 23, and 24A). Conversely, the Hawaiki Nui Submarine Cable - Marine Route Survey and Cable Installation by Hawaiki Submarine Cable Australia Pty Ltd does not require approval provided it is undertaken in a specified manner, as detailed in the EPBC Act (section 75). Assessment approaches for these proposals include Public Environment Reports and Accredited Assessment Processes under the Environmental Protection Act 1986 (WA) (sections 87 and 133). Approval decisions for the Gawara Baya wind farm in Queensland were made with conditions, while variations of conditions of approval were made for the Foxleigh Coal Mine Extension in Queensland and EnergyConnect NSW - Eastern Section in New South Wales (sections 133 and 143). The Act imposes several obligations on parties or entities involved in activities that may impact on national environmental significance matters. These include the requirement to prepare and submit an Environment Report or other documentation detailing the potential environmental impacts of the proposed action (section 87). The Department of Climate Change, Energy, the Environment and Water must then assess the report and determine whether the action requires approval under the Act (section 75). If approval is required, the Act mandates that the action must not be carried out until the approval is granted, subject to any conditions imposed (section 133). Additionally, the Act requires that parties or entities comply with any conditions attached to the approval, which may include measures to mitigate or offset the environmental impacts of the action (section 143). Failure to comply with the requirements of the EPBC Act can result in civil and criminal penalties. Civil penalties for non-compliance with the Act include fines of up to $1.1 million for individuals and $5.5 million for corporations, as well as imprisonment for up to five years (section 511). Criminal penalties for more serious offences, such as knowingly or recklessly causing harm to listed threatened species or communities, can include fines of up to $660,000 for individuals and $3.3 million for corporations, as well as imprisonment for up to seven years (section 512). In addition to these penalties, parties or entities found to have breached the Act may also be subject to orders by the court to take remedial action or compensate for any environmental harm caused (sections 514 and 515).
