Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of Climate Change, Energy, the Environment and Water or may not meet timeframes for notification. The Department of Climate Change, Energy, the Environment and Water has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of Climate Change, Energy, the Environment and Water regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.
Overview
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted by the Parliament of Australia to address the need for a cohesive national framework for the protection of the environment, particularly in relation to matters of national environmental significance. The Act establishes a comprehensive regulatory scheme that aims to protect and manage Australia's environment and biodiversity, including threatened species and ecological communities, heritage places, and water resources. The EPBC Act seeks to achieve its policy objective of sustainable development by integrating environmental considerations into decision-making processes related to activities that may impact the environment. Recent notifications and decisions under the Act, as detailed in the Gazette and the public portal, reflect ongoing efforts to balance development with environmental conservation, as demonstrated by approvals and conditions applied to various projects across the nation.
Scope and Application
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a broad range of activities and entities, encompassing projects and actions that may have a significant impact on matters of national environmental significance. These include listed threatened species and communities, World Heritage properties, wetlands of international significance, and other areas identified under the Act. The Act applies to both Commonwealth and non-Commonwealth activities and entities, extending its jurisdictional reach across Australia, including state and territory boundaries. The application of the Act is not limited to specific industries but rather covers any proposed action that may impact the protected matters, regardless of whether the action is conducted by the government, corporations, or individuals. The Act also includes provisions for exemptions, exclusions, and thresholds, which are determined by the Minister or through subordinate instruments, ensuring that not all activities require approval under the Act. The Act's application may be extended or restricted through regulations and guidelines issued by the relevant authorities, providing flexibility in its enforcement and application to various contexts and circumstances.
Key Provisions
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs various projects and activities that may impact the environment, including listed threatened species and communities, which are addressed under sections 18 and 18A. These sections outline the requirements for assessing and potentially approving projects that may affect these species or communities. For instance, the Cultana Solar Farm project in South Australia and the Moranbah North and Grosvenor Mines rail and pipeline realignment in Queensland are subject to these provisions. The Act mandates that a thorough assessment approach be undertaken, as seen with the preliminary documentation for these projects, to ensure that the environmental impacts are considered.
Under the EPBC Act, parties or entities must comply with the assessment and approval processes outlined in sections 75, 87, and 133. For example, the Cultana Solar Project Company Pty Ltd and Anglo Coal (Moranbah North Management) Pty Limited must submit detailed documentation and undergo an assessment process before any approval can be granted. Similarly, the Lower Murray Urban and Rural Water Corporation and Maclean Estates Pty Ltd must also meet these requirements for their respective projects. These sections mandate that the Department of Climate Change, Energy, the Environment and Water carefully evaluate each project to determine whether it should be approved, and if so, under what conditions.
Failure to comply with the requirements of the EPBC Act may result in various consequences. For instance, section 143 allows for the variation of conditions of approval, which may be necessary if a project does not adhere to the approved conditions. In cases where a project is approved but does not comply with the conditions, the Act provides for enforcement actions. Additionally, section 130(4) allows for the extension of time for certain notifications, which helps in ensuring that the project timeline is met without compromising the quality of the environmental assessment. However, the Act does not specify penalties for missed notifications, but it ensures that any such notifications are made to maintain transparency and accountability.
