Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) includes several key provisions that require or permit various actions related to environmental protection. Section 75 of the Act allows the Minister to determine whether certain actions require approval, such as the Baru-Marnda Renewable Energy Project by Yindjibarndi Energy Corporation (2025/10222) or the Paradise Dam Improvement Project by Sunwater Limited (2025/10229). These determinations are based on the potential impacts on listed threatened species and communities (sections 18 & 18A) and listed migratory species (sections 20 & 20A).
