Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of Climate Change, Energy, the Environment and Water or may not meet timeframes for notification. The Department of Climate Change, Energy, the Environment and Water has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of Climate Change, Energy, the Environment and Water regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.

Overview

The Environment Protection and Biodiversity Conservation Act 1999 was enacted to provide for the protection of the environment, particularly matters of national environmental significance, as well as the conservation of biodiversity. This Act was introduced to address the need for a comprehensive framework to manage and protect the environment, ensuring sustainable development and the preservation of ecosystems. The Act is administered by the Australian Parliament, with the primary policy objective of integrating environmental considerations into decision-making processes for development projects and activities. The Act aims to balance environmental protection with economic and social needs, providing mechanisms for the assessment and approval of actions that may impact the environment.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to various entities and projects across Australia, including individuals, corporations, and government bodies, that propose actions likely to have a significant impact on matters of national environmental significance. These matters include World Heritage properties, national parks, wetlands of international significance, listed threatened species and ecological communities, and listed migratory species. The Act operates across all states and territories within Australia, providing a national framework for environmental protection and biodiversity conservation. Certain actions are exempt from the requirements of the EPBC Act, including those activities that are controlled by state or territory laws and which meet specified criteria. The Act's application may also be extended or restricted through subordinate legislation, allowing for the detailed regulation of specific environmental aspects and processes. The Department of Climate Change, Energy, the Environment and Water is responsible for ensuring the Act's provisions are implemented effectively, including the timely notification of referral decisions, despite occasional administrative lapses.

Key Provisions

The recent notifications under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) outline several key decisions concerning both approvals and non-approvals of various projects. Section 75 of the EPBC Act identifies actions that require approval, such as the Western Green Energy Hub in Western Australia, the Kagaru Residential Development in Queensland, and the Normanville Energy Park in Victoria, all of which involve potential impacts on listed threatened species and communities, migratory species, and wetlands of international importance (ss. 18, 18A, 20, 20A, 23, 24A). These projects necessitate detailed environmental assessments, often requiring an Environmental Impact Statement (s. 87). Conversely, certain actions, such as the Samsung Romani Solar Farm in New South Wales and the Great Ocean Road Coastal Trail in Victoria, have been determined not to require approval (s. 75). These decisions are critical as they determine whether a project must undergo further environmental scrutiny and potential regulatory oversight. The EPBC Act imposes various obligations on the parties involved, including the submission of detailed documentation to assess potential environmental impacts. For instance, the Kagaru Residential Development and the Normanville Energy Park both require preliminary documentation to be submitted before any final decision can be made (s. 87). This ensures that all potential environmental effects are thoroughly evaluated and that appropriate measures are in place to mitigate any adverse impacts. Additionally, where an action is approved, the Act may impose specific conditions to manage these impacts effectively (s. 133). Failure to comply with the provisions of the EPBC Act can result in significant consequences. Breaches of the Act may lead to civil or criminal penalties, depending on the severity of the offence. For example, unauthorised actions that cause harm to listed species or critical habitats can result in substantial fines and, in some cases, imprisonment. The maximum penalties can vary, but they are designed to enforce compliance and protect Australia's unique biodiversity. Additionally, the Act provides mechanisms for the reconsideration of decisions and variations of conditions of approval, allowing for adjustments based on new information or changed circumstances (ss. 78C, 143). These provisions ensure that the Act remains a dynamic and effective tool in environmental protection and biodiversity conservation.
