Overview

The Act covers a wide range of industries, such as mining, residential development, and renewable energy, and encompasses specific conduct and transactions that may affect listed threatened species and communities, water resources, World Heritage, National Heritage, and listed migratory species. The Act operates at a Commonwealth level, providing a national framework for environmental protection and biodiversity conservation. While the Act generally applies to all parts of Australia, certain exclusions and exemptions may apply, including where actions are already regulated by state or territory laws. Section 75 of the Act requires certain actions to be approved by the Minister for the Environment, while Section 87 allows for the assessment approach to be determined, which may include the preparation of a Preliminary Documentation or a Public Environment Report. Similarly, for the Chalumbin Wind Farm project by Chalumbin Wind Farm Pty Ltd, the company must consider the impacts on World Heritage properties (sections 12 & 15A), National Heritage (sections 15B & 15C), listed threatened species and communities (sections 18 & 18A), and listed migratory species (sections 20 & 20A). The EPBC Act also outlines the potential offences, penalties, and civil/criminal consequences for breach of its provisions. For instance, Section 528 of the Act provides for civil penalties for offences related to the destruction or interference with listed threatened species, communities, or their habitats. The maximum penalty for an individual is AUD 220,000 or imprisonment for up to two years, or both. Similarly, Section 532 of the Act provides for criminal penalties for offences related to the unauthorised taking of migratory species. The maximum penalty for an individual is AUD 220,000 or imprisonment for up to one year, or both. It is important to note that the Act also provides for the imposition of administrative penalties, such as fines, for non-compliance with the Act or its regulations. The maximum penalty for an individual is AUD 22,000, while the maximum penalty for a body corporate is AUD 1,100,000.
