Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of Climate Change, Energy, the Environment and Water or may not meet timeframes for notification. The Department of Climate Change, Energy, the Environment and Water has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of Climate Change, Energy, the Environment and Water regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.
Overview
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted by the Australian Parliament to address the protection of the environment, particularly focusing on matters of national environmental significance. This legislation provides a framework for the protection and management of the environment, including biodiversity, heritage places, world heritage properties, wetlands of international importance, and Commonwealth marine areas. The EPBC Act aims to ensure that the federal government can take action to protect the environment from significant impacts caused by developments and activities. The Act includes provisions for the assessment and approval of activities that may have a significant impact on the environment, and it establishes a process for making decisions on whether such activities require federal approval. The policy objective of the Act is to integrate environmental considerations into decision-making processes to achieve sustainable development and conservation of Australia's natural and cultural heritage.
Scope and Application
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to various entities and industries within Australia, specifically targeting actions that may impact listed threatened species, communities, and migratory species, as well as Commonwealth marine areas. This legislation mandates the approval of certain activities through the Commonwealth government, overseen by the Department of Climate Change, Energy, the Environment and Water. The Act extends its jurisdiction to both state and territory levels, covering a wide array of projects such as renewable and non-renewable energy generation, mining, and residential developments. Notably, the Act's application can be extended or restricted through subordinate instruments, which allows for the adaptation of the legislation to specific project needs or environmental concerns. Exclusions and exemptions are detailed within the Act itself, as well as through the assessment and approval processes, which include preliminary documentation reviews and approvals with conditions. The Department has established quality assurance procedures to ensure compliance with notification requirements, despite occasional missed notifications which are rectified to maintain transparency and public trust.
Key Provisions
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) is a crucial piece of legislation that governs the protection of the environment and biodiversity in Australia. Under sections 75 and 133 of the EPBC Act, the Act outlines the requirements for approval of certain actions that may impact the environment, as well as the assessment approach and decisions on approval for these actions. The Act primarily focuses on listed threatened species and communities (sections 18 & 18A), listed migratory species (sections 20 & 20A), and Commonwealth marine areas (sections 23 & 24A) when considering approvals.
The EPBC Act imposes obligations on the entities or parties involved in projects that may impact the environment. For instance, entities such as Prairie Renewable Energy Farm Pty Limited, B&J Catalano Pty Ltd, Santos NA Barossa Pty Ltd, and Australian Resource Development Group Pty Limited must adhere to the provisions of the Act and provide necessary documentation, such as preliminary documentation, to ensure proper assessment of their projects. Additionally, these entities must comply with the conditions set for approved projects, such as the approval of Lendlease Communities (Shoreline) Pty Ltd for the Bayhill Estate and NSW Electricity Networks Operations Pty Ltd for the EnergyConnect NSW - Eastern Section.
Failure to comply with the provisions of the EPBC Act may result in civil and criminal consequences. The maximum penalties for breaches of the Act vary depending on the nature and severity of the offence. However, it is essential for entities and parties involved in projects to adhere to the requirements of the Act to avoid any potential legal repercussions. The Department of Climate Change, Energy, the Environment and Water has implemented quality assurance procedures to minimise any risk of missed notifications within the required timeframe. In cases where a missed notification is identified, the Department will notify the public even if the timeframe for notification has lapsed.
