Determination
Subsection 194C(2) of the Environment Protection and Biodiversity Conservation
Act 1999 (EPBC Act) provides that the Minister must make a determination setting the commencement date for the first twelve (12) month assessment period for the inclusion of items in a Subdivision A List for the purposes of paragraph 194C(1)(a) of the EPBC Act.
Section 194B of the EPBC Act provides that the Subdivision A List means a list referred to in section 178, 181 or 183 of the EPBC Act. These sections establish the lists of threatened species, threatened ecological communities and key threatening processes respectively.
The purpose of this Determination is to set the commencement of the first twelve (12) month assessment period for the Threatened Species Scientific Committee to assess items for inclusion in a Subdivision A List, as 1 October 2007, pursuant to paragraph 194C(1)(a) of the EPBC Act.
Pursuant to subsections 194C(2) of the EPBC Act, such a determination must be made within 3 months after the commencement of the section, and the date set for the commencement of the first twelve (12) month assessment period must not be more than 12 months after the commencement of sections 194C of the EPBC Act. Item 368 of the Environment and Heritage Legislation Amendment Act (No 1) 2006, which amends section 194C, commenced on 19 February 2007.
No consultation has taken place with respect to this instrument as it is of a machinery nature only.
The Determination is a legislative instrument for the purposes of the Legislative Instruments Act 2003.
The Determination commenced on the day after the date on which it was registered on the Federal Register of Legislative Instruments.
