Overview

The legislation F2009B00245, enacted in 1987, serves as an amendment to the Proclamation under the National Parks and Wildlife Conservation Act 1975. This amendment was introduced to address the need for the addition of specific areas of land to be included within the framework of national parks and wildlife conservation in Australia. The enacting body for this legislative instrument was the Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, which underscores the significance of the conservation efforts being undertaken. The policy objective, as implied, is to expand the protected areas under the Act, thereby enhancing the conservation and protection of Australia's unique flora, fauna, and natural environments. This addition to the Proclamation aims to provide a more comprehensive framework for the management and preservation of these vital natural resources.

Scope and Application

The F2009B00245 legislative instrument, which amends the Proclamation under the National Parks and Wildlife Conservation Act 1975, applies to specific areas of land within the Northern Territory of Australia. This amendment adds two new parts to the existing Schedule of the Proclamation, thereby extending the geographical scope of protected land areas. Part VII of the amendment pertains to a land area of approximately 4479 square kilometres, while Part VIII relates to an area of approximately 4.6 hectares, known as the Christmas Creek Reserve. The Act applies to the persons and entities responsible for managing, using, or accessing these designated areas, as well as any industries that operate within them. The amendment is intended to reinforce the conservation efforts stipulated by the National Parks and Wildlife Conservation Act 1975. The legislative instrument operates under the Commonwealth's jurisdiction, with specific geographic reach limited to the Northern Territory. There are no stated exclusions, exemptions, or thresholds within the text provided, and any further application extensions or restrictions would be managed through subordinate instruments as necessary.

Key Provisions

The main operative sections of the proclamation, as amended by this legislative instrument, include the addition of Parts VII and VIII to the Schedule of the National Parks and Wildlife Conservation Act 1975. Part VII adds an area of approximately 4479 square kilometres in the Northern Territory to the national parks, providing detailed boundaries based on geographical coordinates and intersections with existing land leases and portions. Part VIII adds a smaller area of approximately 4.6 hectares, known as the Christmas Creek Reserve, to the national parks with a specified survey plan lodged with the Surveyor-General Darwin Northern Territory. The Act imposes obligations on the parties or entities it governs, including the duty to manage and conserve the added areas as national parks. This includes the responsibility to protect the natural and cultural heritage of these areas, manage visitor access and activities, and ensure the preservation of biodiversity within the parks. Additionally, the proclamation requires compliance with existing environmental laws and regulations applicable to national parks, ensuring that any activities within these areas are conducted in a manner that minimises environmental impact. Failure to comply with the provisions of the National Parks and Wildlife Conservation Act 1975, including the amended proclamation, may result in civil and criminal consequences. Offences under the Act can include unauthorised entry into a national park, damaging or destroying natural or cultural features, and engaging in activities that harm the environment. Penalties for breaches may include fines and, in more severe cases, imprisonment. The maximum penalties for offences under the Act are prescribed in the relevant sections of the legislation, with fines potentially reaching up to $50,000 for individuals and higher amounts for corporations, along with imprisonment terms that can extend up to five years depending on the severity of the offence.
