Overview

The Statutory Rules 1918, No. 16, are regulations made under the Naval Defence Act 1910–1912. Enacted by the Governor-General in the Commonwealth of Australia, these regulations were introduced to provide comprehensive guidelines for the entry, training, and pay of officers within the Royal Australian Naval Reserve. The primary objective of these regulations is to ensure that officers in both the Military and Accountant branches are adequately trained and compensated in accordance with their duties. These regulations came into effect on 4 August 1914, aiming to address the administrative needs of the Royal Australian Naval Reserve during a period of significant military activity and expansion.

Scope and Application

The Statutory Rules 1918, No. 16, made under the Naval Defence Act 1910–1912, govern the entry, training, and pay of officers in the Royal Australian Naval Reserve, particularly focusing on the Accountant Branch. These regulations apply to officers of the Military and Accountant Branches, including those who are eligible for appointment as Assistant Paymasters and Pursers. The geographic and jurisdictional reach of these regulations is the Commonwealth of Australia, as they pertain to the national defence force. The regulations include provisions for the eligibility, training, and duties of officers, specifying that eligible candidates for Assistant Paymaster positions must be between 21 and 35 years of age and have served as Pursers or Assistant Pursers on passenger ships for at least three years. The regulations further detail the training requirements and conditions for probation, confirmation in rank, and potential promotion to Paymaster. Officers of the Accountant Branch are subject to specific regulations regarding their training, service, and termination of commission. Notably, the regulations extend their application through subordinate instruments, which provide detailed operational guidelines and standards for the administration of the Royal Australian Naval Reserve.

Key Provisions

The main operative sections of the Statutory Rules 1918, No. 16, focus on the regulations governing the entry, training, and pay of officers within the Royal Australian Naval Reserve. Regulation 5 introduces the role of Assistant Paymaster, with eligibility criteria based on age and prior service as Purser or Assistant Purser (Regulation 13a). Regulation 18 expands the scope of the Military Branch to include the Accountant Branch, while Regulation 20 alters the references to Military Officers to include those of the Accountant Branch (Regulation 20). New training requirements are introduced in Regulation 28a, stipulating that Assistant Paymasters must undergo 28 days of training in the first year and 14 days annually thereafter until confirmed in rank. Regulation 28b details the training content and evaluation process for Accountant Officers during their afloat training. The regulations impose several obligations on the parties involved. Pursers and Assistant Pursers who meet the age and service criteria are eligible for appointment as Assistant Paymasters (Regulation 13a). Assistant Paymasters must complete the specified training periods to be confirmed in rank, with detailed instructions on the nature and reporting of this training (Regulation 28a, 28b). Officers of all branches must adhere to the same regulations concerning their duties and training (Regulation 31a). Additionally, officers of the Accountant Branch must complete all required training unless excused by the Naval Board (Regulation 28, 66a). The Naval Board holds the discretion to recommend or confirm an officer's rank and may require resignation if the officer leaves the Active List prematurely or takes on incompatible employment (Regulation 66a, 66b). Breaches of the regulations may lead to various consequences. For instance, Assistant Paymasters who do not complete the required training within the specified timeframes may not be confirmed in rank (Regulation 28a, 28b). Officers who leave the Active List prematurely or take on incompatible employment may be required to resign their commission (Regulation 66a, 66b). Furthermore, failure to adhere to the training and service requirements could result in the termination of probationary appointments and loss of eligibility for certain ranks or positions within the Naval Reserve. While the specific penalties for non-compliance are not detailed in the text, the implications of failing to meet these obligations are significant for the affected officers.
