Overview

The Regulations for the Employment of Persons in a Civil Capacity in connexion with the Department of Defence—Amendments, enacted as Statutory Rules 1918 No. 309 under the Defence Act 1903-1918, were introduced to address the need for updated salary and employment conditions for civilian staff working within the Department of Defence. The regulations, made by the Governor-General in accordance with advice from the Federal Executive Council, were designed to provide clearer guidelines on salaries and increments for various positions, as well as to allow for special allowances under certain circumstances. This legislative instrument aimed to ensure fair compensation and adequate remuneration for civilian employees within the Department of Defence, reflecting the evolving nature of their roles and responsibilities during that period.

Scope and Application

The Statutory Rules of 1918, No. 309, under the Defence Act 1903-1918, provide for the regulation of the employment of persons in a civil capacity within the Department of Defence. These regulations amend the previous salary structures and employment conditions for various positions, specifically updating the salary grades and increments for different roles. The amendments affect civil employees within the Department of Defence, establishing specific salary brackets and increments for various positions, such as Armourers, Artisans, and Messengers, among others. The regulations also detail conditions under which employees may receive higher pay rates or allowances, such as performing duties of a higher position or working outside ordinary hours. These provisions are intended to ensure fair compensation and proper grading within the Department of Defence. The regulations apply across the Commonwealth of Australia, overseen by the Governor-General and the Minister of State for Defence. While the primary focus is on civil employees within the Department of Defence, the regulations may be further interpreted or applied through subordinate instruments as deemed necessary by the Department.

Key Provisions

The main operative sections of these Regulations pertain to the amendment of salary scales and allowances for civil employees of the Department of Defence. Regulation 74 has been amended to replace the previous salary tables with new ones that specify the minimum and maximum pay rates and increments for various positions (reg 74). Regulation 76 has been altered to establish a minimum salary requirement for employees in the General Division, depending on their marital status and age (reg 76(1)). Additionally, a new regulation 78a has been introduced, allowing the Secretary to grant special allowances to employees who perform duties beyond their appointed positions or regularly work outside ordinary hours (reg 78a). These Regulations impose specific obligations on the Department of Defence and its employees. The Department must ensure that all civil employees are compensated according to the new salary scales and increments specified in regulation 74. Employees in the General Division must meet the minimum salary requirements set out in regulation 76(1), which vary based on age and marital status. Furthermore, the Secretary is obligated to assess and potentially grant special allowances as stipulated in regulation 78a, considering the nature and duration of the duties performed by the employees. Breach of these Regulations may result in various consequences, although specific offences and penalties are not explicitly detailed within the text. Employees who do not receive the minimum salary as outlined in regulation 76(1) may have grounds to contest their compensation, potentially leading to administrative or legal action. Similarly, if the Secretary fails to properly assess and grant special allowances in accordance with regulation 78a, employees could seek redress for perceived unfair treatment. The precise legal ramifications and penalties for non-compliance, however, are not explicitly stated in the Regulations.
