Overview

The Statutory Rules 1923 No. 173, Regulations under the Defence Act 1903-18, were enacted to govern the employment of civil personnel within the Department of Defence. The regulations were established to ensure the smooth operation of civil roles within the defence sector and were made by the Governor-General in Council, acting on advice from the relevant authorities. The primary objective of these regulations was to provide clear guidelines and classifications for employee roles, ensuring equitable and structured compensation and advancement opportunities. These regulations came into effect on 27 September 1923, and aimed to address the need for organised employment standards and classifications within the Department of Defence.

Scope and Application

The Regulations under the Defence Act 1903-18 apply to individuals employed in a civil capacity in connection with the Department of Defence. The regulations cover a range of employment conditions, including the classification of employees, salary rates, and allowances. The regulations apply to all employees within the Commonwealth of Australia, providing a consistent framework for employment terms and conditions across the defence sector. The regulations also allow for the Secretary to set salary rates that may exceed those determined by an Arbitration Court, Public Service Arbitrator, or Wages Board, if warranted due to special skill, general efficiency, or long service. Notably, these regulations do not apply to officers in Class A.1, as they are classified under different salary bands. The application of these regulations is extensive, covering various roles within the Department of Defence, and they are designed to ensure fair and equitable treatment of employees within the defence sector.

Key Provisions

The primary operative sections of these Regulations (C1923L00173) under the Defence Act 1903-18, as amended, detail the employment of persons in a civil capacity within the Department of Defence. Regulation 40a now mandates that officers or employees receiving allowances under specific conditions must notify the Chief Officer if they become ineligible for such allowances. Regulation 74 outlines the classification of employees in the General Division, detailing salary scales, increments, and remarks for various positions such as Assistants, Caretakers, Messengers, and others. Notably, Regulation 74 (2) specifies that employees may be paid rates determined by arbitration courts or wages boards, subject to approval by the Secretary, who may also grant higher rates based on special skills, efficiency, or long service. Regulation 75 allows for higher salaries for Male Senior Assistants performing clerical duties, up to £272 per annum, subject to the Secretary's approval. Regulation 76 establishes minimum salaries for employees who have attained the age of twenty-one, with married employees receiving a minimum of £208 per annum. The Regulations impose specific obligations on the parties and entities they govern. Officers and employees must notify the Chief Officer if they become ineligible for allowances under the prescribed conditions. The Secretary is responsible for approving salary rates and increments, ensuring that employees receive pay rates determined by arbitration courts, wages boards, or Public Service Arbitrators, and may approve higher rates based on special circumstances. The Secretary also has the authority to classify employees and determine salary scales and increments for various positions within the General Division. The Regulations outline several consequences for breach. While the specific offences and penalties are not explicitly detailed in the text, it is reasonable to infer that failure to comply with these provisions, such as not notifying the Chief Officer of ineligibility for allowances or unauthorized changes to salary rates, could result in disciplinary actions or other administrative consequences. Additionally, the text suggests that any unauthorized deviation from the prescribed salary scales or conditions could be subject to review and potential corrective action by the Secretary.
