Overview

The Statutory Rules 1919, No. 276, were enacted by the Governor-General in Council, under the authority granted by the Commonwealth Electoral Act 1918-1919 and the Referendum (Constitution Alteration) Act 1906-1919. The purpose of these regulations was to amend existing electoral and referendum regulations to address specific issues in the Northern Territory, particularly concerning postal voting processes. This legislative instrument aimed to streamline and clarify the procedures for postal voting in remote areas, ensuring that the electoral process was both accessible and efficient for voters in the Northern Territory. The regulations were designed to provide clarity and enhance the administration of elections and referendums, particularly by empowering the Assistant Returning Officer in the Northern Territory with additional responsibilities and clarifying the forms and procedures for postal voting.

Scope and Application

These Regulations, issued under the Commonwealth Electoral Act 1918-1919 and the Referendum (Constitution Alteration) Act 1906-1919, pertain specifically to the administration of elections and referendums within the Northern Territory of Australia. They extend to the powers and duties of the Assistant Returning Officer in the Northern Territory, granting them the authority to manage voting by post, which is subject to the oversight of the Divisional Returning Officer for the relevant electoral division. This includes the use of specific forms for postal voting applications and certificates, tailored to the Northern Territory, as outlined in the Regulations. The amendments to the Electoral and Referendum Regulations also modify the forms used in the Northern Territory to reflect the local administrative structure, ensuring that the processes align with the unique geographical and logistical considerations of the region. These changes are designed to streamline the voting process for residents in the Northern Territory, ensuring that their participation in federal elections and referendums is facilitated in a manner appropriate to their circumstances.

Key Provisions

The primary operative sections of the Statutory Rules 1919, No. 276, focus on the amendments to the Electoral and Referendum Regulations under the Commonwealth Electoral Act 1918-1919 and the Referendum (Constitution Alteration) Act 1906-1919. Regulation 45a grants the Assistant Returning Officer in the Northern Territory the same powers as a Divisional Returning Officer in relation to voting by post, subject to the control of the Divisional Returning Officer (reg. 45a). Regulation 45b specifies the forms to be used for applications and certificates for postal votes in the Northern Territory, detailing the necessary alterations to Forms 122, 22, and 23 (reg. 45b). Regulation 2 removes Form C (Ballot-paper) and Form C (Special Form of Ballot-paper) from the Schedule of the Electoral and Referendum Regulations (reg. 2). Regulation 3 omits the words “—Special Form” from Form 25a in the Schedule (reg. 3). Regulation 5 adds a new form to the end of the Schedule, amending the Electoral and Referendum Regulations (reg. 5). The Act imposes specific obligations and requirements on the Assistant Returning Officer in the Northern Territory. They must exercise their powers under regulation 45a in accordance with the control and directives of the Divisional Returning Officer. The Assistant Returning Officer must ensure that applications for postal vote certificates and postal ballot-papers are made in accordance with Form 122 and that postal vote certificates conform to Form 23 (reg. 45b). Additionally, they must make the necessary amendments to Forms 22 and 23 as specified in regulation 45b. There are no explicit offences, penalties, or civil/criminal consequences mentioned in the Statutory Rules 1919, No. 276. However, non-compliance with the regulations could lead to procedural errors in the electoral process, potentially affecting the validity of votes cast under the amended regulations. Any such procedural errors might be subject to review or challenge under the applicable electoral laws, with potential implications for the administration of the electoral process in the Northern Territory.
