Overview

The Drought Relief Act 1945 was enacted by the Australian Parliament to amend the States Grants (Drought Relief) Act 1944, addressing the urgent need for financial assistance to states affected by drought. The Act was introduced in response to the severe drought conditions experienced across various regions in Australia, particularly those impacting agricultural production. The primary objective of this legislation is to provide increased financial relief to the affected states by amending the amount of the grant appropriated from £1,500,000 to £1,855,000. Additionally, the Act authorises the Minister to allocate funds from the Consolidated Revenue for drought relief specifically in the Australian Capital Territory, aiming to alleviate the hardship faced by individuals involved in the production of wheat, oats, barley, or related by-products. The Drought Relief Act 1945 signifies a response to the immediate needs of the agricultural sector during a period of severe drought, ensuring that necessary financial resources are made available to mitigate the adverse effects on livelihoods and economic stability in the affected areas. This legislative action underscores the Commonwealth's commitment to supporting state governments and local communities in times of natural disaster.

Scope and Application

The Drought Relief Act 1945 amends the States Grants (Drought Relief) Act 1944, and serves to enhance financial assistance measures during periods of drought, particularly focusing on relief for states affected by such conditions. This legislation applies to all states within the Commonwealth of Australia, specifically targeting those engaged in the production of wheat, oats, barley, or related products within the Australian Capital Territory. The Act provides for the payment of financial assistance from the Consolidated Revenue Fund, aimed at alleviating the hardship experienced by these producers due to drought. The financial assistance is not limited to a specific amount but is designated to be applied as the Minister sees fit, up to a total of One thousand five hundred pounds. This Act extends its application through the appropriation of funds from the Consolidated Revenue Fund and is applicable nationally across Australia, with a specific focus on the Australian Capital Territory. The Act does not specify any exclusions, exemptions, or thresholds beyond the geographical and sectoral limitations mentioned.

Key Provisions

The Drought Relief Act 1945 primarily amends the States Grants (Drought Relief) Act 1944 by increasing the financial assistance provided to certain states (section 2). Instead of the previous amount of one million five hundred thousand pounds, the Act now provides for one million eight hundred and fifty-five thousand pounds. Additionally, it authorises the Minister to allocate up to one thousand five hundred pounds from the Consolidated Revenue Fund for the relief of hardship caused by drought in the Australian Capital Territory, specifically for individuals involved in the production of wheat, oats, barley, or wheaten or oaten hay (section 3). Under this Act, the Minister is granted the authority to distribute financial assistance to states affected by drought, with the specific amount of assistance now set at one million eight hundred and fifty-five thousand pounds (section 2). Furthermore, the Minister can allocate funds from the Consolidated Revenue Fund to alleviate hardship caused by drought in the Australian Capital Territory for specified agricultural activities (section 3). These provisions are intended to provide immediate financial relief and support to those affected by drought conditions in the relevant areas. The Act imposes certain obligations on the Minister, including the responsibility to appropriately distribute the increased financial assistance to the states (section 2) and to allocate funds from the Consolidated Revenue Fund for drought relief in the Australian Capital Territory (section 3). The Minister must ensure that the funds are used effectively to alleviate the hardship caused by drought to the specified agricultural sectors. Failure to comply with the provisions of the Act may result in legal consequences. While the Act does not explicitly detail specific offences or penalties, breaches of the obligations outlined could potentially lead to legal action or penalties under general administrative or statutory law, depending on the nature and extent of the non-compliance. The precise penalties would be determined by the relevant courts or tribunals, taking into account the severity and circumstances of the breach.
