Overview
The Dried Vine Fruits Equalization Levy Regulations (Repeal) Statutory Rules 1981 No. 3771 was enacted to repeal the previous Dried Vine Fruits Equalization Levy Regulations and address any inconsistencies or outdated provisions that may have existed within the regulations governing the dried vine fruits industry. This legislative instrument was made by the Governor-General, acting with the advice of the Federal Executive Council, and following the recommendations of the Australian Dried Fruits Corporation to the Minister of State for Primary Industry, pursuant to section 8 of the Dried Vine Fruits Equalization Levy Act 1978. The objective of these regulations was to ensure a streamlined and up-to-date legal framework for the dried vine fruits industry, thereby facilitating efficient and effective administration of the levy system.
Scope and Application
The Dried Vine Fruits Equalization Levy Regulations (Repeal) Statutory Rules 1981 No. 3771 applies to the repeal of previous regulations concerning the levy on dried vine fruits within the Commonwealth of Australia. This legislative instrument operates under the authority of the Dried Vine Fruits Equalization Levy Act 1978, and it is applicable to entities involved in the production, processing, and sale of dried vine fruits, ensuring compliance with the updated regulatory framework. The repeal of the former Dried Vine Fruits Equalization Levy Regulations 1979 signifies an adaptation to the current legislative requirements, affecting all stakeholders within the dried vine fruit industry across Australia. The regulations' geographic reach is national, and the repeal is comprehensive, indicating no specific exclusions or thresholds mentioned within this statutory instrument. The application of the Act is further extended or restricted through subordinate instruments as deemed necessary by the relevant authorities.
Key Provisions
The Dried Vine Fruits Equalization Levy Regulations (Repeal) (No. 3771 of 1981) sets forth the repeal of the previously enacted Dried Vine Fruits Equalization Levy Regulations (No. 269 of 1979). These regulations come into effect on 1 January 1982, as stated in Section 1 of the Statutory Rules. This repeal effectively nullifies the older regulations, which were established under the Dried Vine Fruits Equalization Levy Act 1978. Section 2 of the Statutory Rules explicitly outlines the repeal of the older regulations.
The Dried Vine Fruits Equalization Levy Regulations (Repeal) imposes no new obligations on the parties or entities it governs, as its primary function is to repeal the previously existing regulations. Instead, it serves to streamline and update the legislative framework by removing outdated or superseded provisions. This repeal is a procedural measure designed to ensure that the regulatory environment remains current and aligned with any changes in policy or legislative intent.
Under the Dried Vine Fruits Equalization Levy Regulations (Repeal), there are no specific offences, penalties, or consequences for breach, as the repeal itself does not introduce new regulatory requirements. However, any existing obligations or requirements that were outlined in the repealed regulations are no longer enforceable. Parties and entities that were previously subject to the regulations should ensure they are aware of any new or continuing obligations under the Dried Vine Fruits Equalization Levy Act 1978 or any other relevant legislation. Compliance with the current legislative framework remains crucial to avoid any potential legal ramifications.
The Repeal Regulations (No. 3771 of 1981) serve to tidy up the legislative landscape by removing outdated regulatory provisions. By repealing the older regulations, it ensures that the legal framework governing dried vine fruits remains relevant and efficient. While the repeal does not introduce new obligations, it is important for all affected parties to stay informed about the current legal requirements to maintain compliance.
