Overview

The Statutory Rules 1920 No. 214, made under the Distillation Act 1901-1918, were enacted to amend the existing distillation regulations, specifically updating the forms used to determine the weight per gallon of spirits using a Sikes' hydrometer. This regulation was issued by the Governor-General in accordance with the advice of the Federal Executive Council. The objective was to refine and standardise the measurement process for the distillation of spirits, ensuring consistency and accuracy in the industry. The update to the forms was essential for maintaining regulatory compliance and facilitating the accurate assessment of distilled spirits in accordance with the Act.

Scope and Application

The Regulation under the Distillation Act 1901-1918 applies to entities involved in the distillation industry within the Commonwealth of Australia. It particularly pertains to the measurement and determination of the weight per gallon of spirits, as indicated by Sikes' Hydrometer. This regulation is aimed at ensuring accurate measurement and compliance with distillation standards. It does not explicitly state any exclusions or exemptions but implies that it applies universally to all relevant entities within its scope. The regulation extends its application through the use of specific forms (N and N (1)) provided in the schedule, which detail tables for determining the weight per gallon of spirits using Sikes’ Hydrometer and Sikes’ Negative or Extended Hydrometer. These forms provide a systematic method for entities to ascertain the weight of spirits, ensuring consistency and accuracy across the industry.

Key Provisions

The regulation under the Distillation Act 1901-1918 amends the existing Distillation Regulations 1913, specifically repealing and replacing the forms N and N (1) in the schedule (Regulation 119). The new form N includes a table for determining the weight per gallon of spirits using a Sikes’ Hydrometer, while form N (1) provides a table for determining the weight per gallon of spirits using a Sikes’ Negative or Extended Hydrometer. These tables provide the necessary information to convert the hydrometer readings into the weight of spirits per gallon, which is essential for compliance with the Distillation Act. The parties or entities governed by these regulations, which include distillers, manufacturers, and other relevant stakeholders, must adhere to the requirements set forth in these tables. This includes using the hydrometers in accordance with the instructions provided to accurately measure the weight of spirits per gallon. Proper documentation and record-keeping of these measurements are also necessary to demonstrate compliance with the Act. Failure to comply with the provisions of the Distillation Act 1901-1918 and the accompanying regulations may result in various civil and criminal consequences. While the specific penalties are not outlined in the text provided, it is reasonable to assume that penalties could include fines, imprisonment, or other legal actions as prescribed by the Act and any relevant case law. The severity of the penalties would likely depend on the nature and extent of the non-compliance, as well as any resulting harm or losses caused by the violation.
