The legislative authority under which the instrument is made

 

Subsection 12(2) of annual Appropriation Act (No. 1) 20082009 enables the Minister for Finance and Deregulation (Finance Minister) to make a determination reducing a CAC Act body payment item. 

 

A determination made under subsection 12(2) must be in accordance with a written request made to the Finance Minister by the responsible Minister for the agency.

 

A Determination made under subsection 12(2) is a Legislative Instrument and is disallowable.

 

Purpose and effect of the instrument

 

Schedule 1, Item 1 of the instrument determines that the CAC Act body payment item for the Department of the Environment, Water, Heritage and the Arts (Environment) for payment to the National Film and Sound Archive (NFSA) in Appropriation Act (No. 1) 2008-2009 be reduced by $90,000.

The effect of this instrument is to reduce the CAC Act body payment item for Environment for payment to the NFSA in Schedule 1 of Appropriation Act (No. 1) 2008-2009 by the amount of $90,000.

Background

The Minister for the Environment, Heritage and the Arts wrote to the Finance Minister on 14 November 2008 requesting a determination to reduce Environment’s CAC Act body payment item for payment to the NFSA under Appropriation Act (No. 1) 2008-2009. 

The request was made in order to reduce the appropriation for an amount that should have been provided under Appropriation Act (No. 2) 2008-2009 in order to better reflect the capital nature of the expenditure.

Notes on the Instrument

Schedule 1 to the instrument contains the Determination which provides that the agency in column 1, has the appropriation item in column 2, under the legislative authority in column 3, through the request by the responsible Minister in Column 4, reduced, by the amount in column 5.

In accordance with the Legislative Instruments Act 2003, Environment was consulted in the preparation of this instrument.
