The legislative authority under which the instrument is made | Subsection 9(1) of Appropriation Act (No. 1) 2004-2005 enables the Minister for Finance and Deregulation (Finance Minister) to make a Determination reducing a departmental item. A determination under subsection 13(1) must be in accordance with a written request made to the Finance Minister by the Minister responsible for the Agency. |
Purpose and effect of the instrument | Departmental items provided in the annual appropriation Acts do not automatically lapse at the end of the financial year. The Finance Minister can issue a Determination to reduce an amount that is excess to an agency’s requirements. The effect of this instrument is to reduce the departmental item for the Australian Customs and Border Protection Service in Schedule 1 of Appropriation Act (No. 1) 2004‑2005 by $8,460,000. |
Background | The Minister for Home Affairs wrote to the Finance Minister on 15 December 2009 requesting a determination to reduce the Australian Customs and Border Protection Service’s departmental item in Appropriation Act (No. 1) 2004‑2005. The reduction represents a saving arising from the leasing of a vessel for the Southern Oceans Program in 2004-05. |
Notes on the Instrument | Schedule 1 to the instrument contains the Determination which provides that the entity in column 1 has the appropriation item in column 2, under the legislative authority in column 3, which through the request by the responsible Minister in column 4, is reduced by the amount in column 5. In accordance with the Legislative Instruments Act 2003, the Australian Customs and Border Protection Service was consulted in the preparation of the instrument. |
