The legislative authority under which the instrument is made
| Subsection 11(1) of annual Appropriation Acts (No. 2) and (No. 4) enable the Minister for Finance and Deregulation (Finance Minister) to make a determination reducing an administered assets and liabilities item or an other departmental item for an entity.
A determination made under subsection 11(1) must be in accordance with a written request made to the Finance Minister by the responsible Minister for the entity.
A determination made under subsection 11(1) is a Legislative Instrument and is disallowable. |
Purpose and effect of the instrument
| Schedule 1, Item 1 of the Instrument determines that the other departmental item (Equity Injections) for the Australian Taxation Office (ATO) in Appropriation Act (No. 2) 2007‑2008 be reduced by $4,278,000.
The effect of this Instrument is to reduce the other departmental item (Equity Injections) for ATO in Schedule 2 of Appropriation Act (No. 2) 2007-2008 by the amount of $4,278,000. |
| Schedule 2, Item 1 of the Instrument determines that the other departmental item (Equity Injections) for the Australian Bureau of Statistics (ABS) in Appropriation Act (No. 4) 2007‑2008 be reduced by $2,968,000.
The effect of this Instrument is to reduce the other departmental item (Equity Injections) for ABS in Schedule 2 of Appropriation Act (No. 4) 2007-2008 by the amount of $2,968,000. |
| Schedule 2, Item 2 of the Instrument determines that the other departmental item (Equity Injections) for the Australian Securities and Investments Commission (ASIC) in Appropriation Act (No. 4) 2007‑2008 be reduced by $1,407,000.
The effect of this Instrument is to reduce the other departmental item (Equity Injections) for ASIC in Schedule 2 of Appropriation Act (No. 4) 2007-2008 by the amount of $1,407,000. |

Background | The Treasurer wrote to the Finance Minister on 18 June 2009 requesting a determination to reduce ATO’s other departmental item (Equity Injections) under Appropriation Act (No. 2) 2007‑2008.
The requested reduction relates to the re-allocation of appropriations provided for the Standard Business Reporting measure and the Australian Business Number and Business Names Registration measure. |
