The legislative authority under which the instrument is made | Subsection 13(2) of Appropriation Act (No. 2) 2009-2010 enables the Minister for Finance and Deregulation (Finance Minister) to make a Determination reducing administered assets and liabilities items and other departmental items. A determination under subsection 13(1) must be in accordance with a written request made to the Finance Minister by the Minister responsible for the Agency. |
Purpose and effect of the instrument | Other departmental items provided in the annual appropriation Acts do not automatically lapse at the end of the financial year. The Finance Minister can issue a Determination to reduce an amount that is excess to an agency’s requirements. The effect of this instrument is to reduce the other departmental item (Equity Injections) appropriation item for the Department of Defence in Schedule 2 of Appropriation Act (No. 2) 2009-2010 by $1,592,535,000. |
Background | The Minister for Defence wrote to the Finance Minister on 14 December 2009 requesting a determination to reduce the Department of Defence’s Equity Injections in Appropriation Act (No. 2) 2009‑2010. The amount of the reduction is the sum of a number of savings arising from: movements in foreign exchange rates; a reclassification of appropriation from non-operating to operating; and, the direct appropriation of amounts to the Defence Materiel Organisation for work performed on Defence’s behalf. |
Notes on the Instrument | Schedule 1 to the instrument contains the Determination which provides that the entity in column 1 has the appropriation item in column 2, under the legislative authority in column 3, which through the request by the responsible Minister in column 4, is reduced by the amount in column 5. In accordance with the Legislative Instruments Act 2003, the Department of Defence was consulted in the preparation of the instrument. |
