The legislative authority under which the instrument is made
| Subsection 10(2) of annual Appropriation Act (No. 1) 2008‑2009 enables the Minister for Finance and Deregulation (Finance Minister) to make a determination reducing a departmental item.
A determination made under subsection 10(2) must be in accordance with a written request made to the Finance Minister by the responsible Minister for the agency.
A determination made under subsection 10(2) is a Legislative Instrument and is disallowable. |
Purpose and effect of the instrument
| Schedule 1, Item 1 of the Instrument determines that the departmental item for the Australian Federal Police (AFP) in Appropriation Act (No. 1) 2008-2009 be reduced by $7,590,087.
The effect of this Instrument is to reduce the departmental item for AFP in Schedule 1 of Appropriation Act (No. 1) 2008-2009 by the amount of $7,590,087. |
| Schedule 1, Item 2 of the Instrument determines that the departmental item for the Office of the Director of Public Prosecutions (ODPP) in Appropriation Act (No. 1) 2008-2009 be reduced by $572,944.
The effect of this Instrument is to reduce the departmental item for ODPP in Schedule 1 of Appropriation Act (No. 1) 2008-2009 by the amount of $572,944. |
| Schedule 1, Item 3 of the Instrument determines that the departmental item for the Department of Education, Employment and Workplace Relations (DEEWR) in Appropriation Act (No. 1) 2008-2009 be reduced by $40,000,000.

Background | The Minister for Home Affairs wrote to the Finance Minister on 28 May 2009 requesting a determination to reduce AFP’s departmental item under Appropriation Act (No. 1) 2008‑2009.
The requested reduction relates to excess funding requirements for the deployment of AFP personnel to Afghanistan. |
| The Attorney-General wrote to the Finance Minister on 21 May 2009 requesting a determination to reduce ODPP’s departmental item under Appropriation Act (No. 1) 2008‑2009.
A reduction was sought because the planned level of prosecutions for serious cartel conduct did not occur, as the amendments to the Trade Practices Act 1974 are not yet passed in parliament. |
| The Minister for Education, Employment and Workplace Relations wrote to the Finance Minister on 27 May 2009 requesting a determination to reduce DEEWR’s departmental item under Appropriation Act (No. 1) 2008‑2009.
The requested reduction is due to a reduction in service delivery costs payable to Centrelink as a result of lower than expected customer numbers. |

Notes on the Instrument | Schedule 1 to the Instrument contains the Determination which provides that the agency in column 1, has the appropriation item in column 2, under the legislative authority in column 3, through the request by the responsible Minister in Column 4, reduced, by the amount in column 5.
In accordance with the Legislative Instruments Act 2003, AFP, ODPP, DEEWR and MA were consulted in the preparation of this Instrument. |
