The legislative authority under which the instrument is made
| Subsection 9(1) of annual Appropriation Acts (No. 1) and (No. 3) enable the Minister for Finance and Deregulation (Finance Minister) to make a determination reducing a departmental item.
A determination made under subsection 9(1) must be in accordance with a written request made to the Finance Minister by the responsible Minister for the entity.
A determination made under subsection 9(1) is a Legislative Instrument and is disallowable. |
Purpose and effect of the instrument
| Schedule 1, Item 1 of the Instrument determines that the departmental item for the Office of Workplace Services (OWS) in Appropriation Act (No. 3) 2006-2007 be reduced by $7,154,000.
The effect of this Instrument is to reduce the departmental item for OWS in Schedule 1 of Appropriation Act (No. 3) 2006-2007 by the amount of $7,154,000. |
| Schedule 2, Item 1 of the Instrument determines that the departmental item for the Australian Federal Police (AFP) in Appropriation Act (No. 1) 2007-2008 be reduced by $3,888,005.
The effect of this Instrument is to reduce the departmental item for AFP in Schedule 1 of Appropriation Act (No. 1) 2007-2008 by the amount of $3,888,005. |
| Schedule 2, Item 2 of the Instrument determines that the departmental item for the Australian Institute of Marine Science (AIMS) in Appropriation Act (No. 1) 2007-2008 be reduced by $15,000.
The effect of this Instrument is to reduce the departmental item for AIMS in Schedule 1 of Appropriation Act (No. 1) 2007-2008 by the amount of $15,000. |
| Schedule 3, Item 1 of the Instrument determines that the departmental item for the Department of Agriculture, Fisheries and Forestry (DAFF) in Appropriation (Drought and Equine Influenza Assistance) Act (No. 1) 2007-2008 be reduced by $3,000. The effect of this Instrument is to reduce the departmental item for DAFF in Schedule 1 of Appropriation (Drought and Equine Influenza Assistance) Act (No. 1) 2007-2008 by the amount of $3,000. |
Background | The Minister for Employment and Workplace Relations wrote to the Finance Minister on 5 June 2009 requesting a determination to reduce OWS’ departmental item under Appropriation Act (No. 3) 2006-2007.
The requested reduction relates to unspent advertising funding no longer required following the cessation of OWS which was replaced by the Office of the Workplace Ombudsman. |
| The Minister for Home Affairs wrote to the Finance Minister on 28 May 2009 requesting a determination to reduce AFP’s departmental item under Appropriation Act (No. 1) 2007‑2008.
The requested reduction relates to a lower than expected number of uniformed police officers seconded from the state police forces. |

Each provision provides that the entity in column 1, has the appropriation item in column 2, under the legislative authority in column 3, through the request by the responsible Minister in Column 4, reduced, by the amount in column 5.
