The legislative authority under which the instrument is made

 

Subsection 11(1) of annual Appropriation Acts (No. 2) and (No. 4) enables the Minister for Finance and Deregulation (Finance Minister) to make a determination reducing an administered assets and liabilities item or an other departmental item for an entity. 

 

A determination made under subsection 11(1) must be in accordance with a written request made to the Finance Minister by the responsible Minister for the entity.

 

A determination made under subsection 11(1) is a Legislative Instrument and is disallowable.

 

Purpose and effect of the instrument

 

Schedule 1, Item 1 of the Instrument determines that the administered assets and liabilities item for the Department of Education, Science and Training (DEST) in Appropriation Act (No. 4) 2003-2004 be reduced by $4,819,999.90.

The effect of this Instrument is to reduce the administered assets and liabilities item for DEST in Schedule 2 of Appropriation Act (No. 4) 2003-2004 by the amount of $4,819,999.90.

 

Schedule 2, Item 1 of the Instrument determines that the administered assets and liabilities item for DEST in Appropriation Act (No. 4) 2005-2006 be reduced by $266.20.

The effect of this Instrument is to reduce the administered assets and liabilities item for DEST in Schedule 2 of Appropriation Act (No. 4) 2005-2006 by the amount of $266.20.

 

Schedule 3, Item 1 of the Instrument determines that the other departmental item (Equity Injections) for the Department of Education, Employment and Workplace Relations (DEEWR) in Appropriation (Northern Territory National Emergency Response) Act (No. 2) 2007-2008 be reduced by $2,783,252.

The effect of this Instrument is to reduce the other departmental item (Equity Injections) for DEEWR in Schedule 2 of Appropriation (Northern Territory National Emergency Response) Act (No. 2) 2007-2008 by the amount of $2,783,252.

Background

The Minister for Education, Employment and Workplace Relations and Social Inclusion wrote to the Finance Minister on 18 December 2008 requesting a determination to reduce DEST’s administered assets and liabilities item under Appropriation Act (No. 4) 2003-2004. 

The requested reduction relates to savings associated with the National Radioactive Waste Repository.

 

The Minister for Education, Employment and Workplace Relations and Social Inclusion wrote to the Finance Minister on 18 December 2008 requesting a determination to reduce DEST’s administered assets and liabilities item under Appropriation Act (No. 4) 2005-2006. 

The requested reduction relates to savings associated with the National Radioactive Waste Repository.

 

The Minister for Education, Employment and Workplace Relations and Social Inclusion wrote to the Finance Minister on 18 December 2008 requesting a determination to reduce DEEWR’s other departmental item (Equity Injections) under Appropriation (Northern Territory National Emergency Response) Act (No. 2) 2007-2008. 

The request was made due to underspends in Northern Territory Emergency Response initiatives.
