Explanatory Statement
Appropriation Act (No. 1) 2007-2008, subsection 9(1) – Reduction of appropriations upon request
The instrument to which this explanatory statement relates
This explanatory statement relates to an instrument (the instrument) entitled “Determination to Reduce Appropriation Upon Request”, dated 21 May 2008 and numbered 6 of 2007-2008.
The legislative authority under which the instrument is made
Section 9 of Appropriation Act (No. 1) 2007-2008 enables the Finance Minister to make a determination reducing a departmental item for an entity upon receipt of a written request from the Minister responsible or, in the case of an entity the Finance Minister is responsible for, the Chief Executive.
The provisions were included in the Appropriation Acts to enable excess departmental appropriation items to be extinguished.
Excess appropriation may arise where, for example:
- An amount is reclassified and appropriated again under another kind of appropriation;
- Efficiency savings result in a programme costing less than expected; and
- A programme under Government policy is abolished prior to the appropriation being expensed.
In accordance with subsection 9(1) of Appropriation Act (No. 1) 2007-2008, a determination issued by the Finance Minister cannot reduce an appropriation item by more than the lesser of the amount requested by the responsible Minister or Chief Executive (as appropriate), and the balance of the appropriation item remaining in the Consolidated Revenue Fund.
Purpose of the instrument
The instrument directs that the departmental item for the Commonwealth Scientific and Industrial Research Organisation (CSIRO) in Appropriation Act (No. 1) 2007-2008 be reduced by $1,310,000.
Background
On 23 April 2008, the Minister for Innovation, Industry, Science and Research wrote to the Minister for Finance and Deregulation requesting a determination to reduce CSIRO’s departmental items under Appropriation Act (No. 1) 2007-2008 by $1,310,000. This reduction is due to savings associated with the Healthy Active Australia – Promoting Healthy Living measure and the application of the one-off two per cent efficiency dividend.
Notes on the instrument
The instrument provides that the appropriation items in column 1 for the entity in column 2 be reduced in response to a request made by the Minister in column 4 by the amounts listed in column 6.
In accordance with the Legislative Instruments Act 2003, CSIRO was consulted in the preparation of this instrument.
Overview
The Appropriation Act (No. 1) 2007-2008 was enacted by the Parliament of Australia to manage and allocate government funds for specific purposes during the fiscal year 2007-2008. This Act addresses the need for flexibility in financial management by allowing for the reduction of appropriations when unexpected savings occur or when programs are abolished before the appropriation is expensed. The Act was designed to ensure that government spending remains efficient and aligned with current needs and policies. Section 9 of the Act specifically empowers the Finance Minister to reduce a departmental appropriation item upon request from the relevant Minister or Chief Executive, ensuring that any reduction does not exceed the requested amount or the remaining balance in the Consolidated Revenue Fund.
The policy objective of the Act is to maintain fiscal discipline and efficiency in government spending, ensuring that funds are utilised effectively and only to the extent necessary. The legislative instrument, "Determination to Reduce Appropriation Upon Request", dated 21 May 2008, was issued under the authority of this Act to facilitate a reduction in the appropriation for the Commonwealth Scientific and Industrial Research Organisation (CSIRO) by $1,310,000, reflecting savings from specific measures and efficiency initiatives. This reduction was requested by the Minister for Innovation, Industry, Science and Research and approved by the Minister for Finance and Deregulation, in accordance with the provisions of the Act.
Scope and Application
The Determination to Reduce Appropriation Upon Request instrument, numbered 6 of 2007-2008 and dated 21 May 2008, pertains specifically to the Commonwealth Scientific and Industrial Research Organisation (CSIRO) and its departmental appropriation under the Appropriation Act (No. 1) 2007-2008. This instrument was authorised under section 9 of the Appropriation Act and responds to a written request from the relevant Minister, in this case the Minister for Innovation, Industry, Science and Research, seeking to reduce CSIRO’s appropriation by $1,310,000. The reduction is due to savings from the Healthy Active Australia – Promoting Healthy Living measure and a one-off two per cent efficiency dividend. The reduction is limited to the amount requested by the Minister or the balance of the appropriation item remaining in the Consolidated Revenue Fund, whichever is lesser. The instrument is a Commonwealth instrument and applies nationally across all jurisdictions within Australia, affecting the financial allocations for CSIRO under the specified appropriation act.
Key Provisions
The main operative sections of the "Determination to Reduce Appropriation Upon Request" instrument, numbered 6 of 2007-2008, are encapsulated within section 9(1) of the Appropriation Act (No. 1) 2007-2008. This section empowers the Finance Minister to reduce a departmental appropriation item for an entity upon receiving a written request from the responsible Minister or the Chief Executive if the Finance Minister is responsible for the entity. The reduction is limited to the lesser of the requested amount or the balance remaining in the Consolidated Revenue Fund. This provision is intended to facilitate the extinguishment of excess appropriation items that may arise from various scenarios, such as reclassification of funds, efficiency savings, or the abolition of a government program before its appropriation is expensed.
The obligations and requirements imposed by the Act on the parties involved are straightforward. The responsible Minister or Chief Executive must submit a written request to the Finance Minister to reduce a departmental appropriation item. The Finance Minister is then obligated to issue a determination that reduces the appropriation by the requested amount, provided it does not exceed the remaining balance of the appropriation item in the Consolidated Revenue Fund. Additionally, the Act mandates that the entity, in this case the Commonwealth Scientific and Industrial Research Organisation (CSIRO), be consulted in the preparation of the instrument, as stipulated by the Legislative Instruments Act 2003.
Breach of the provisions outlined in the Act does not explicitly outline specific offences, penalties, or civil/criminal consequences. However, the failure to adhere to the prescribed procedures for reducing an appropriation item, such as not submitting a written request or exceeding the allowable reduction amount, could lead to legal challenges regarding the validity of the reduction. The Act ensures that any reduction must not contravene the balance remaining in the Consolidated Revenue Fund, thus maintaining fiscal integrity and adherence to budgetary processes. While the Act itself does not detail maximum penalties for non-compliance, any resulting fiscal mismanagement or irregularities could potentially lead to broader administrative or financial repercussions for the involved entities.
