The legislative authority under which the Instrument is made is detailed in Clause 3 of the Determination.

Purpose and effect of the instrument

This Determination reduces the relevant appropriation items to the revised amount required specified for the agencies listed in the Schedules.  The revised amount required in column 5 of each item applies as if it is the amount specified in the relevant agency’s annual report or in the case of Appropriation Act (No. 1) 2007-2008, Appropriation Act (No. 2) 2007-2008, Appropriation Act (No. 1) 2006-2007, Appropriation Act (No. 1) 2005-2006, or Appropriation Act (No. 1) 2004-2005), the total accrued administered expenses of the relevant agency.

Background

Schedule 1: Reduction of Administered Appropriation Act (No. 1) 2009-2010

Item 1 of Schedule 1 determines that the Outcome 2 administered item for the Attorney-General’s Department (AGD) in Appropriation Act (No. 1) 2009-2010 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This reduced amount was held for paying prior year accruals, which is no longer required.

Item 2 of Schedule 1 determines that the Outcome 2 administered item for the Department of Infrastructure, Transport, Regional Development and Local Government (DoITRDLG) in Appropriation Act (No. 1) 2009-2010 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  As DoITRDLG’s 2009-2010 administered accrued expenses have now been paid in full, this appropriation is excess to requirements.

Item 3 of Schedule 1 determines that the Outcome 3 administered item for DoITRDLG in Appropriation Act (No. 1) 2009-2010 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  As DoITRDLG’s 2009-2010 administered accrued expenses have now been paid in full, this appropriation is excess to requirements.

Item 4 of Schedule 1 determines that the Outcome 1administered item for the Australian Taxation Office (ATO) in Appropriation Act (No. 1) 2009-2010 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This appropriation relates to administered advertising funding for various campaign activities.  The amount is excess as a result of actual payments made being lower than expected.

 

 

 

Schedule 2: Reduction of Administered Appropriation Act (No. 3) 2009-2010

Item 1 of Schedule 2 determines that the Outcome 1 administered item for the ATO in
Appropriation Act (No. 3) 2009-2010 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This appropriation relates to administered advertising funding for various campaign activities.  The amount is excess as a result of actual payments made being lower than expected.

Schedule 3: Reduction of Administered Appropriation Act (No. 1) 2008-2009

Item 1 of Schedule 3 determines that the Outcome 1 administered item for the AGD in
Appropriation Act (No. 1) 2008-2009 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This reduced amount was held for paying prior year accruals, which is now no longer required.

Item 2 of Schedule 3 determines that the Outcome 2 administered item for the AGD in
Appropriation Act (No. 1) 2008-2009 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This reduced amount was held for paying prior year accruals, which is now no longer required.

Schedule 4: Reduction of Administered Appropriation Act (No. 2) 2008-2009

Item 1 of Schedule 4 determines that the Outcome 1 administered item for the AGD in
Appropriation Act (No. 2) 2008-2009 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This reduced amount was held for paying prior year accruals, which is now no longer required.

Item 2 of Schedule 4 determines that the Outcome 3 administered item for the AGD in
Appropriation Act (No. 2) 2008-2009 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This reduced amount was held for paying prior year accruals, which is now no longer required.

Schedule 5: Reduction of Administered Appropriation Act (No. 5) 2008-2009

Item 1 of Schedule 5 determines that the Outcome 1 administered item for the ATO in
Appropriation Act (No. 5) 2008-2009 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This appropriation relates to administered advertising funding for various campaign activities.  The amount is excess as a result of a rounding difference.

Schedule 6: Reduction of Administered Appropriation Act (No. 1) 2007-2008

Item 1 of Schedule 6 determines that the Outcome 2 administered item for the AGD in
Appropriation Act (No. 1) 2007-2008 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  This reduced amount was held for paying prior year accruals, which is now no longer required.

 

 

Item 2 of Schedule 6 determines that the Outcome 1 administered item for the Department of Foreign Affairs and Trade (DFAT) in Appropriation Act (No. 1) 2007-2008 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  The amount of appropriation retained to meet payment obligations to International Organisations was excess to the actual amount paid.

Schedule 7: Reduction of Administered Appropriation Act (No. 2) 2007-2008

Item 1 of Schedule 7 determines that the Outcome 3 administered item for the AGD in
Appropriation Act (No. 2) 2007-2008 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  This reduced amount was held for paying prior year accruals, which is now no longer required.

Schedule 8: Reduction of Administered Appropriation Act (No. 1) 2006-2007

Item 1 of Schedule 8 determines that the Outcome 1 administered item for DFAT in
Appropriation Act (No. 1) 2006-2007 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  The amount of appropriation retained to meet payment obligations to International Organisations was excess to the actual amount paid.

Schedule 9: Reduction of Administered Appropriation Act (No. 1) 2005-2006

Item 1 of Schedule 9 determines that the Outcome 2 administered item for DFAT in
Appropriation Act (No. 1) 2005-2007 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  The amount of appropriation retained to meet payment obligations to International Organisations was excess to the actual amount paid.

Item 2 of Schedule 9 determines that the Outcome 3 administered item for DFAT in
Appropriation Act (No. 1) 2005-2007 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  The amount of appropriation retained to meet payments related to the Discretionary Grants program was excess to the actual amount paid.

Schedule 10: Reduction of Administered Appropriation Act (No. 1) 2004-2005

Item 1 of Schedule 10 determines that the Outcome 1administered item for DFAT in
Appropriation Act (No. 1) 2004-2005 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  The amount of appropriation retained to meet payment obligations to International Organisations was excess to the actual amount paid.

Item 2 of Schedule 10 determines that the Outcome 2 administered item for DFAT in
Appropriation Act (No. 1) 2004-2005 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount.  The amount of appropriation retained for payments related to committed traveller loans under the Traveller Emergency Loans Program was excess to the actual amount paid.

Item 3 of Schedule 10 determines that the Outcome 3 administered item for DFAT in
Appropriation Act (No. 1) 2004-2005 is reduced to the determined amount and applies as if the amount specified in the determination was the required amount. The amount of appropriation retained to meet payments related to the Discretionary Grants program was excess to the actual amount paid.

Item 4 of Schedule 10 determines that the Outcome 1administered item for the ATO in
Appropriation Act (No. 1) 2004-2005 is reduced to the required amount and applies as if the amount specified in the agency annual report was the required amount specified in the determination.  This appropriation relates to a measure which was announced in the 2004-2005 Budget to provide fringe benefits tax transitional grants to State, Territory and Local Government organisations as compensation for lost access to a fringe benefits tax concession.  This amount is excess as a result of a concluded program.

Notes on the instrument

The Schedules contain reduction determinations for agencies under the relevant Appropriation Acts to which the determination applies.  Each table provides the relevant agency, appropriation item and outcome number contained in the relevant annual Appropriation Act in column 1, the legislative authority in column 2, the amount appropriated by Parliament against that appropriation item and outcome in column 3, the amount appropriated by determination or annual report for the appropriation item in column 4, the new amount required by the agency against that appropriation item and outcome in column 5, and the amount reduced in column 6.

For Schedules 1 to 5 the amount required by the agency in column 5 is the amount that is taken to be the specified amount required for the appropriation item for the purposes of the agency’s annual report.

For Schedules 6 to 10 the amount required by the agency in column 5 is the amount specified in the determination as the required amount.

In accordance with the Legislative Instruments Act 2003, the agencies concerned were consulted in the preparation of this instrument.

Human Rights Impact Statement

This determination reduces appropriated money from subsection 11(2)(b) of Appropriation Act (No. 1) 2009-2010, subsection 11(2)(b) of Appropriation Act (No. 3) 2009-2010, subsection 11(2)(b) of Appropriation Act (No. 1) 2008-2009, subsection 12(2)(b) of Appropriation Act (No. 2) 2008-2009; subsection 11(2)(b) of Appropriation Act (No. 5) 2008-2009;subsection 8(1)(b) of Appropriation Act (No. 1) 2007-2008;subsection 8(1)(b) of Appropriation Act (No. 2) 2007-2008;subsection 8(1)(b) of Appropriation Act (No. 1) 2006-2007; subsection 8(1)(b) of Appropriation Act (No. 1) 2005-2006; and subsection 8(1)(b) of Appropriation Act (No. 1) 2004-2005.

This determination does not engage any of the applicable rights or freedoms outlined in the Human Rights (Parliamentary Scrutiny) Act 2011.

This determination is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011 as it does not raise any human rights issues.
