EXPLANATORY STATEMENT

Environment Protection and Biodiversity Conservation Act 1999

 

Determination

 

Subsection 324G(2) of the Environment Protection and Biodiversity Conservation

Act 1999 (EPBC Act) provides that the Minister must make a determination setting the commencement date for the first twelve (12) month assessment period for the inclusion of places in the National Heritage List for the purposes of paragraph 324G(1)(a) of the EPBC Act.

 

Subsection 341G(2) of the EPBC Act provides that the Minister must make a determination setting the commencement date for the first twelve (12) month assessment period for the inclusion of places in the Commonwealth Heritage List for the purposes of paragraph 341G(1)(a) of the EPBC Act.

 

The purpose of this Determination is to set the commencement of the first twelve (12) month assessment period for the Australian Heritage Council to assess places for inclusion in the National Heritage List and the Commonwealth Heritage List, as

1 July 2007, pursuant to paragraphs 324G(1)(a) and 341G(1)(a) of the EPBC Act. 

 

Pursuant to subsections 324G(2) and 341G(2) of the EPBC Act, such a determination must be made within 3 months after the commencement of those sections, and the date set for the commencement of the first twelve (12) month assessment period must not be more than 12 months after the commencement of sections 324G and 341G of the EPBC Act.  Items 550 and 567 of the Environment and Heritage Legislation Amendment Act (No 1) 2006, which amend sections 324G and 341G respectively, commenced on 19 February 2007.

 

No consultation has taken place with respect to this instrument as it is of a machinery nature only. 

 

The Determination is a legislative instrument for the purposes of the Legislative Instruments Act 2003. 

 

The Determination commenced on the day after the date on which it was registered on the Federal Register of Legislative Instruments.
