Overview

The Determination 03 of 2024, made under section 38E of the Parliamentary Service Act 1999, amends the remuneration for the Parliamentary Librarian within the Department of Parliamentary Services. This legislative action was initiated by the President of the Senate, Senator the Hon Sue Lines, and the Speaker of the House of Representatives, the Hon Milton Dick MP, following advice from the Remuneration Tribunal. This amendment addresses the need to update the remuneration package for the Parliamentary Librarian to reflect current market standards and responsibilities. The policy objective of this amendment is to ensure that the remuneration of the Parliamentary Librarian remains competitive and commensurate with the critical role they play in supporting the legislative process. The amendment, which comes into effect from 1 July 2024, revises the base salary and total remuneration for the Parliamentary Librarian. Specifically, the base salary is set at $279,882 per annum, with total remuneration amounting to $332,500 per annum. This change replaces the previous remuneration structure as outlined in Determination 26 of 2023, aiming to accurately reflect the value of the Librarian's contributions and responsibilities within the parliamentary framework.

Scope and Application

This amendment determination applies to the remuneration of the Parliamentary Librarian within the Department of Parliamentary Services, specifically modifying the remuneration package as outlined in the original Determination 26 of 2023. The changes affect the base salary and total remuneration of the Librarian, setting the base salary at $279,882 per annum and the total remuneration at $332,500 per annum. This determination is made under the authority of section 38E of the Parliamentary Service Act 1999, and it applies to the Commonwealth of Australia, thereby affecting federal parliamentary operations. The amendment is directly related to the individual role of the Parliamentary Librarian, without any stated exclusions or exemptions, and is effective from 1 July 2024. The application of this amendment is confined to the specified role and does not extend to other positions or departments unless explicitly stated in subordinate instruments or further amendments.

Key Provisions

The main operative sections of Determination 03 of 2024 involve the amendment of the remuneration for the Parliamentary Librarian, Department of Parliamentary Services. Specifically, Clause 2.1 repeals the previous clause and substitutes it with new remuneration rates (Clause 2.1). According to this clause, the Librarian will be eligible for a base salary of $279,882 per annum and a total remuneration of $332,500 per annum. This Determination, which amends the previous Determination 26 of 2023, is effective from 1 July 2024. The Act imposes specific obligations on the parties it governs, particularly in relation to the remuneration of the Parliamentary Librarian. The President of the Senate and the Speaker of the House of Representatives are mandated to make such amendments in accordance with the advice received from the Remuneration Tribunal, as per section 38E(1) of the Parliamentary Service Act 1999. This ensures that the remuneration of the Librarian is reviewed and adjusted appropriately, reflecting the advice and recommendations provided by the Tribunal. Failure to comply with the provisions of this Determination may result in civil or administrative consequences. While specific offences and penalties are not detailed in the text, it is implied that non-compliance with the remuneration rates set out in the Determination could lead to legal ramifications. The exact consequences would depend on the broader context of the Parliamentary Service Act 1999 and any related regulations or guidelines. The Determination itself does not specify maximum penalties, but the implications of non-compliance could potentially include financial repercussions or legal action against the parties responsible for failing to implement the new remuneration rates.
