The policy objective of this determination is to ensure the remuneration for the Secretary remains competitive and reflective of the role's responsibilities and the broader economic context.
Scope and Application
The Determination 02 of 2024 under the Parliamentary Service (Remuneration) Amendment Act pertains to the remuneration and other conditions of appointment for the Secretary of the Department of Parliamentary Services. This amendment applies directly to the individual holding the position of Secretary, ensuring that their compensation aligns with the prescribed rates as outlined in the determination. The legislation operates within the Commonwealth jurisdiction, affecting a key position within the federal government’s administrative framework. There are no stated exclusions or exemptions within the determination, and it supersedes the previous remuneration rates specified in Determination 1 of 2020. The application of this amendment is straightforward and does not extend to other entities or industries, remaining focused solely on the remuneration of the Secretary. The commencement date of this amendment is 1 July 2024, ensuring that the new remuneration rates are effective from this date.
Key Provisions
The main operative sections of this Amendment Determination (C2024G00549) are Clause 2.1 and the commencement clause. Clause 2.1 outlines the new remuneration package for the Secretary of the Department of Parliamentary Services, stipulating a base salary of $460,437 per annum and a total remuneration package of $490,370 per annum. This clause directly amends the previous remuneration package outlined in Determination 1 of 2020, and it comes into effect from 1 July 2024.
Under this Amendment Determination, the Secretary of the Department of Parliamentary Services is now eligible for a revised remuneration package. The determination sets the base salary at $460,437 annually and total remuneration at $490,370 annually. This includes base salary as well as other entitlements and benefits. This change is made to align with the advice and recommendations provided by the Remuneration Tribunal, ensuring that the remuneration reflects current market conditions and the responsibilities associated with the role.
The Amendment Determination imposes specific obligations on the parties involved. The Secretary of the Department of Parliamentary Services must now adhere to the new remuneration conditions set out in Clause 2.1. The determination also binds the President of the Senate and the Speaker of the House of Representatives to the advice provided by the Remuneration Tribunal and mandates the implementation of the new remuneration package from the specified commencement date of 1 July 2024. This ensures that the remuneration conditions are updated and followed in accordance with the legislative requirements.
There are no specific offences, penalties, or civil/criminal consequences outlined for breaching this Amendment Determination. However, failure to comply with the new remuneration conditions could potentially lead to legal challenges or disputes regarding the implementation of the remuneration package. Given the legislative nature of the amendment, non-compliance could result in the need for further legislative action or judicial review to enforce adherence to the new conditions. The precise legal consequences would depend on the specific circumstances of any non-compliance.
