……………………………….

MATTHEW CANAVAN

Minister for Resources and Northern Australia

Dated this 1st day of September 2016

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) was enacted to regulate the exploration, production and storage of petroleum and greenhouse gas offshore Australia. The Act was introduced to address the need for a robust legislative framework that governs the environmental, economic, and social impacts of offshore petroleum activities. This Act was passed by the Parliament of the Commonwealth of Australia with the policy objective of ensuring the sustainable development of offshore petroleum resources while protecting the environment and the rights of stakeholders. In 2016, a delegation under section 68 of the Act was made by Matthew Canavan, the Minister for Resources and Northern Australia, revoking all existing delegations and delegating his powers to the General Manager, Offshore Resources Branch, Resources Division, Department of Industry, Innovation and Science of the Commonwealth of Australia. This delegation aimed to streamline the decision-making process and ensure efficient administration of the Act by empowering the designated officeholder with the necessary authority.

Scope and Application

The delegation under section 68 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, made by the Minister for Resources and Northern Australia, Matthew Canavan, pertains to the offshore area of the Territory of Ashmore and Cartier Islands. This delegation revokes all existing delegations and assigns all powers under the Act and the regulations to the person who currently holds the office of General Manager, Offshore Resources Branch, Resources Division, Department of Industry, Innovation and Science of the Commonwealth of Australia. The Act applies to entities and persons involved in offshore petroleum activities and greenhouse gas storage operations within the designated offshore area, thus encompassing a range of industries and transactions related to these activities. The jurisdictional reach of the Act extends to the Commonwealth, specifically focusing on the offshore area of the Territory of Ashmore and Cartier Islands. The delegation does not specify exclusions or exemptions within the text provided, and its scope is further extendable or modifiable through subordinate instruments, such as regulations and further ministerial delegations.

Key Provisions

The primary operative section of the delegation under section 68 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) is the revocation of all existing delegations and the subsequent delegation of the powers of the Minister for Resources and Northern Australia (section 68). Specifically, Matthew Canavan, as the Minister, revokes all existing delegations and reassigns his powers to the person who currently holds, occupies, or performs the duties of the office of General Manager, Offshore Resources Branch, Resources Division, Department of Industry, Innovation and Science of the Commonwealth of Australia. This reassignment encompasses all powers under the Act, except for the power of further delegation. The obligations imposed by this Act are primarily administrative in nature. The Minister for Resources and Northern Australia, by revoking previous delegations and issuing a new one, ensures that the powers necessary for managing offshore petroleum and greenhouse gas storage activities in the Territory of Ashmore and Cartier Islands are held by a specified individual within the Department of Industry, Innovation and Science. This re-delegation clarifies the chain of authority and responsibility, ensuring that the appropriate person within the department is empowered to exercise the relevant powers under the Act. Breaches of the provisions outlined in this delegation could lead to various civil and criminal consequences depending on the context and the specific provisions of the Act they contravene. The Act itself, not this delegation, would stipulate the nature of these consequences. Typically, breaches might include failure to comply with the Act's requirements, which could lead to enforcement actions, fines, or other penalties. The maximum penalties for offences under the Act can vary widely, depending on the specific provision breached and the severity of the offence. For instance, offences related to non-compliance with safety regulations or environmental protection measures might incur significant fines, while more serious breaches, such as those involving gross negligence, could lead to imprisonment. However, the specific penalties are detailed in the Act itself, not in this delegation instrument.
