I, BARNABY JOYCE, the Minister for Resources and Northern Australia, for the Commonwealth of Australia, as the Joint Authority for the offshore area of the Territory of Ashmore and Cartier Islands, under section 68 of the Act hereby revoke all existing delegations and delegate all my powers and functions under the Act (other than the power of delegation) and the regulations to the person who, from time to time, holds, occupies, or performs the duties of the office of General Manager, Offshore Resources Branch, Resources Division, Department of Industry, Innovation and Science of the Commonwealth of Australia.
(signed by Barnaby Joyce)
……………………………….
BARNABY JOYCE
Minister for Resources and Northern Australia
Dated this 14th day of August 2017
Overview
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) was enacted to provide for the regulation of activities related to the exploration for and exploitation of offshore petroleum and the storage of greenhouse gas. The Act was introduced to address the need for comprehensive legislation to manage the environmental, economic, and safety considerations associated with offshore petroleum activities and greenhouse gas storage within Australia's offshore areas. The enacting body was the Commonwealth Parliament, and the policy objective was to ensure that these activities are carried out in a manner that protects the environment, promotes sustainable development, and safeguards public interests. The 2017 delegation under section 68 of the Act, signed by Barnaby Joyce, the Minister for Resources and Northern Australia, further refines the administration of these powers by assigning them to the General Manager of the Offshore Resources Branch within the Department of Industry, Innovation and Science. This delegation streamlines the management of offshore petroleum and greenhouse gas storage activities in the Territory of Ashmore and Cartier Islands.
Scope and Application
The Act pertains to the Offshore Petroleum and Greenhouse Gas Storage Act 2006, which governs the regulation of offshore petroleum and greenhouse gas storage activities in Australian waters. Specifically, this delegation under Section 68 of the Act applies to the powers and functions of the Joint Authority for the offshore area of the Territory of Ashmore and Cartier Islands, which are vested in the Minister for Resources and Northern Australia, Barnaby Joyce. The scope of this delegation includes the revocation of all existing delegations and the assignment of authority to the General Manager of the Offshore Resources Branch within the Department of Industry, Innovation and Science of the Commonwealth of Australia. This authority encompasses the regulation and management of offshore petroleum activities and greenhouse gas storage within the specified territorial waters. The jurisdictional reach of the Act is confined to the offshore area of the Territory of Ashmore and Cartier Islands, thereby applying specifically to activities and operations within these defined geographic boundaries. The Act does not explicitly outline exclusions, exemptions, or thresholds within this delegation, though it is subject to the broader provisions and regulations of the Offshore Petroleum and Greenhouse Gas Storage Act 2006. Additionally, the application and interpretation of the Act may be extended or restricted through subordinate instruments, which are not detailed in this particular delegation but are integral to the overall legislative framework.
Key Provisions
The key operative sections of the Gazette C2017G00967, issued under Section 68 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act), pertain to the delegation of powers and functions to specific officials within the Commonwealth of Australia. Section 68 specifically empowers the Minister for Resources and Northern Australia to delegate any of their powers and functions under the Act to another individual. In this instance, the Minister, Barnaby Joyce, has revoked all existing delegations and delegated all his powers and functions under the Act (excluding the power to delegate) to the person who holds the office of General Manager, Offshore Resources Branch, Resources Division, Department of Industry, Innovation and Science.
The Act imposes clear obligations on the parties it governs, primarily stipulating that the Minister's powers and functions under the Act are to be exercised by the designated General Manager. This includes the administration and oversight of offshore petroleum and greenhouse gas storage activities within the designated offshore area, ensuring compliance with the provisions of the Act and related regulations. The General Manager is tasked with managing the application process for offshore activities, issuing permits, and overseeing the environmental and operational standards required by the Act.
Failure to comply with the requirements set out in the Act can lead to significant consequences. The Act provides for both civil and criminal penalties for breaches, including fines and imprisonment. The maximum penalties for offences under the Act can vary depending on the specific breach and the severity of the offence. For example, certain breaches may incur fines up to several thousand Australian dollars, while more serious offences could result in imprisonment for several years. Additionally, the Act allows for the imposition of administrative penalties and the revocation of permits, which can further impact those found in breach of the Act's provisions. The enforcement of these penalties is critical in maintaining the integrity of offshore petroleum and greenhouse gas storage operations within Australia's jurisdiction.
