I, MATTHEW CANAVAN, the Minister for Resources and Northern Australia, for the Commonwealth of Australia, as the ‘Commonwealth-Tasmania Offshore Petroleum Joint Authority’ and ‘the responsible Commonwealth Minister’ for the Tasmanian offshore area hereby revoke all existing delegations and delegate all my powers under the Act (other than the power of delegation) and the regulations to the person who, from time to time, holds, occupies, or performs the duties of General Manager, Offshore Resources Branch, Resources Division, Department of Industry, Innovation and Science of the Commonwealth of Australia.

……………………………….
MATTHEW CANAVAN
Minister for Resources and Northern Australia
Dated this 1st day of September 2016
Overview
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) was enacted by the Parliament of Australia to address the regulation and management of offshore petroleum activities and greenhouse gas storage within Australian waters. This legislation aims to establish a comprehensive regulatory framework that ensures the sustainable and environmentally responsible exploration, production, and storage of offshore petroleum resources while mitigating potential environmental impacts. The Act provides for the granting of titles for offshore petroleum activities and the imposition of conditions to safeguard the marine environment. It also facilitates the storage of greenhouse gases to contribute to global climate change mitigation efforts. In line with its policy objective of efficient and responsible resource management, the Act allows for the delegation of powers to relevant authorities to effectively implement and enforce its provisions. This specific delegation, issued by the Minister for Resources and Northern Australia under Section 66A of the Act, aims to streamline the administrative processes and ensure the continuity of governance in managing offshore petroleum activities within the Tasmanian offshore area.
Scope and Application
The delegation under Section 66A of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 pertains to the powers of the Commonwealth-Tasmania Offshore Petroleum Joint Authority and the responsible Commonwealth Minister, specifically concerning the Tasmanian offshore area. This Act applies to the Minister for Resources and Northern Australia, who, in this case, is Matthew Canavan. The Act delegates all powers under the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (other than the power of delegation) and the regulations to the General Manager of the Offshore Resources Branch within the Resources Division of the Department of Industry, Innovation and Science of the Commonwealth of Australia. This delegation extends to the person who holds, occupies, or performs the duties of the General Manager from time to time. The revocation of existing delegations ensures that all powers and responsibilities are transferred to the designated individual, thereby streamlining the administration and enforcement of the Act. The scope of this legislation is specific to the management of offshore petroleum activities and greenhouse gas storage within the jurisdiction of the Commonwealth and Tasmania, impacting entities and industries involved in these sectors.
Key Provisions
The main operative sections of the Delegation under Section 66A of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) are critical in understanding the transfer of powers. Under this delegation, the Minister for Resources and Northern Australia, Matthew Canavan, revokes all existing delegations and assigns all his powers under the Act, except for the power of delegation itself, to the General Manager of the Offshore Resources Branch, Resources Division, Department of Industry, Innovation and Science of the Commonwealth of Australia. This is detailed in section 66A of the Act, which allows the Minister to delegate specific powers to a designated individual within the Department.
The obligations imposed by this delegation are significant for ensuring the effective administration of offshore petroleum and greenhouse gas storage activities in the Tasmanian offshore area. The General Manager, as the delegate, is now responsible for exercising the powers vested in them by the Minister. This includes the authority to manage and regulate activities related to offshore petroleum exploration, production, and storage, as well as ensuring compliance with the Act and its regulations. This delegation ensures that a specific individual is accountable for the implementation and oversight of these activities, thereby maintaining a structured and controlled approach to the management of offshore resources.
In terms of consequences for breaches, the Act itself outlines potential penalties and consequences for non-compliance. While the delegation itself does not specify additional penalties, it is implicit that failure to comply with the Act or the regulations could result in significant civil or criminal penalties. For instance, under the Act, offences related to unauthorised activities can attract hefty fines and imprisonment. The maximum penalties for certain offences can be substantial, reflecting the importance of adhering to the regulatory framework designed to protect Australia's offshore resources and environment. The General Manager, as the delegate, would be responsible for ensuring compliance and taking action against any breaches, thereby upholding the integrity of the Act.
