Overview
The Statutory Rules 1976 No. 51, made under the Defence Act 1903-1975, were enacted to amend the Defence (Prohibited Words and Letters) Regulations, providing a regulatory framework for the use of specific words and letters that are indicative of parts of the Australian Defence Force. These regulations were established to ensure that certain military designations and acronyms are not misused, thereby maintaining the integrity and professionalism of the Australian Defence Force. The enacting body for these regulations is the Governor-General of the Commonwealth of Australia, acting on the advice of the Executive Council, which underscores the legislative authority vested in these amendments. The primary objective of these regulations is to prevent the unauthorised use of military titles and designations, thereby protecting the distinctive identity of the Australian Navy, Army, and Air Force.
Scope and Application
The Statutory Rules 1976 No. 51, Regulations under the Defence Act 1903-1975, pertain specifically to the Defence (Prohibited Words and Letters) Regulations, governing the use of specific words and letters associated with the Australian Navy, Army, and Air Force. These regulations apply to any person or entity that uses or displays these words or letters in a manner that could be misleading or inappropriate, thereby affecting the integrity and distinct identity of these defence forces. The regulations extend across the Commonwealth of Australia and are applicable to any conduct or transactions involving the use of these prohibited terms, regardless of the location within Australia. The regulations do not explicitly mention any exclusions, exemptions, or thresholds, and their scope is primarily defined by the terms listed in the Schedule. The regulations are designed to be comprehensive, though they may be further refined or extended through subordinate instruments as needed.
Key Provisions
The key operative sections of the Statutory Rules 1976 No. 51 are concerned with the amendments to the Defence (Prohibited Words and Letters) Regulations (Regulation 2). The Regulations modify the list of prohibited words and letters related to the Australian Navy, Army, and Air Force (Regulation 2). This amendment seeks to provide clarity and specificity to the categories of prohibited words and letters by replacing certain terms and updating the references to align with the current naming conventions of the Australian Defence Force (ADF) services. The changes include the replacement of specific wording in paragraph (a) and the removal and substitution of terms in paragraph (b) (Regulation 2). The regulation also includes updates to the monetary penalties for breaches (Regulation 5) and the removal of outdated or redundant parts of the Schedule (Schedule).
The Regulations impose specific obligations on individuals and entities to refrain from using the prohibited words and letters in relation to the Australian Navy, Army, or Air Force, as outlined in the amended Schedule. This prohibition is intended to prevent unauthorised use of these terms, which may lead to confusion or misrepresentation of the ADF services (Regulation 2). The Regulations also require compliance with the updated monetary penalties for breaches (Regulation 5). The updated Schedule now includes more precise references to the ADF services, which assists in enforcing the prohibitions effectively (Schedule).
Failure to comply with the Regulations may result in a financial penalty of $40 (Regulation 5). The Regulations do not specify any criminal penalties for breaches, implying that the primary consequence of non-compliance is the financial penalty. The penalties apply to any person who uses the prohibited words or letters in a manner that contravenes the Regulations (Regulation 5). The updated Schedule, which includes more specific references to the ADF services, aids in the enforcement of these prohibitions, ensuring that only authorised uses of these terms are permitted (Schedule).
