This instrument is the Defence (Non-foreign work restricted individual) Determination 2024.
3 Authority
This instrument is made under subsection 115(1) of the Act.
4 Definitions
Act means the Defence Act 1903.
agency head has the same meaning as in the Public Service Act 1999.
APS employee has the same meaning as in the Public Service Act 1999.
SES employee has the same meaning as in the Public Service Act 1999.
Star ranked officer means a member of the Australian Defence Force that holds a rank mentioned in items 3, 4 or 5 of the table in Schedule 1 to the Act.
Note: A number of expressions used in this instrument are defined in the Act, including the following:
(a) defence staff member;
(b) foreign work restricted individual;
(c) service chief.
5 Individuals that are not foreign work restricted individuals
(1) The following class of individuals comprises individuals who are not foreign work restricted individuals for the purposes of subsection 114(2) of the Act:
(a) an individual that:
(i) previously worked in one or more roles, positions, functions, ranks or appointments mentioned in an item of a table in Schedule 1; and
(ii) satisfies the relevant condition mentioned in column 5 of a table in Schedule 1 for each role, position, function, rank and appointment that the individual previously worked in.

The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.
Misdescribed amendments
A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under section 15V of the Legislation Act 2003.
If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.
