Overview
The Interim Determination under section 12 of the Defence Amendment Act 1979, made by the Minister of State for Administrative Services on behalf of the Minister of State for Defence, concerns the repeal of specific regulations related to Defence Force salaries. Dated 20 August 1981, this legislative instrument addresses the need to streamline and update the existing Defence Force (Salaries) Regulations, specifically removing regulations 14a, 14b, and 14c, as well as Schedule 16. This repeal is intended to ensure that the regulations align with the current legislative framework and administrative practices. The Interim Determination is set to take effect on the day Determination 2607, concerning the Recreation Leave Bonus, is made under section 58b of the Defence Act 1903. This action was notified in the Commonwealth of Australia Gazette on 4 September 1981 and references prior amendments made to the Defence Force (Salaries) Regulations.
Scope and Application
This legislative instrument pertains to the Defence Forces (Salaries) Regulations and serves to repeal certain sections and a schedule related to the Defence Force (Salaries) Regulations. Specifically, the Interim Determination, made under section 12 of the Defence Amendment Act 1979, removes regulations 14a, 14b, and 14c, as well as Schedule 16 from the existing Defence Force (Salaries) Regulations. The Interim Determination applies to the Defence Force members and is effective upon the enactment of Determination 2607, which addresses the Recreation Leave Bonus under the Defence Act 1903. The legislative instrument is a Commonwealth instrument, impacting the administration and remuneration of defence personnel. There are no stated exclusions or exemptions in this Interim Determination, and it operates within the broader framework of defence-related legislation. Subordinate instruments may further extend or restrict the application of this Interim Determination as deemed necessary by the Minister of State for Administrative Services acting on behalf of the Minister of State for Defence.
Key Provisions
The main operative sections of the Statutory Rules 1981 No. 254 are the repeal of certain regulations and the application of the Interim Determination. Specifically, Regulations 14a, 14b, and 14c of the Defence Force (Salaries) Regulations, as well as Schedule 16, are repealed (section 1). This repeal takes effect concurrently with the implementation of Determination 2607, which concerns the Recreation Leave Bonus under section 58b of the Defence Act 1903 (section 2). The Interim Determination is made under section 12 of the Defence Amendment Act 1979, signifying its authority and the context in which it operates.
The obligations and requirements imposed by this Act primarily involve the formal repeal of specified regulations. This repeal ensures that the outdated or redundant regulations are no longer in effect, thereby updating the legal framework governing the salaries of Defence Force members. The timing of the repeal, aligned with the Recreation Leave Bonus determination, indicates a coordinated effort to revise and modernise Defence Force regulations comprehensively. This alignment likely aims to ensure that all relevant changes are implemented simultaneously, reducing confusion and maintaining consistency within the Defence Force's administrative practices.
There are no explicit offences, penalties, or consequences for breach detailed within the text of the Statutory Rules 1981 No. 254. The document focuses on the administrative and procedural aspects of repealing certain regulations and does not address enforcement measures or sanctions for non-compliance. However, it is important to note that the repeal of regulations would likely necessitate updates in related administrative procedures and systems to ensure compliance with the new legal framework. Failure to adhere to these updated procedures could result in administrative inefficiencies or potential legal implications, although such consequences are not specified within this particular legislative instrument.
