Overview

The Statutory Rules 1971 No. Regulations under the Defence Forces Retirement Benefits Act 1948-1970, made by the Governor-General on the advice of the Federal Executive Council, were enacted to update the specified amount for the purposes of section 4A of the Defence Forces Retirement Benefits Act. The Act, initially enacted in 1948 and subsequently amended in 1970, was established to provide retirement benefits to members of the Australian Defence Force, addressing the need for financial security for these individuals upon their retirement from service. The regulations serve to ensure that the benefits remain current and reflective of the economic context of the time, thereby maintaining the intended support for retired defence force members. The policy objective is to adjust the financial parameters of the benefits to accurately reflect the economic conditions and provide adequate support to the beneficiaries.

Scope and Application

The Defence Forces Retirement Benefits Regulations, as amended in 1971, apply to individuals who are or were members of the Australian Defence Force and are eligible for retirement benefits under the Defence Forces Retirement Benefits Act 1948-1970. These regulations provide specific details regarding the calculation and payment of benefits, ensuring that eligible members receive their due entitlements. The regulations are made under the authority of the Commonwealth of Australia and are intended to govern the administration of retirement benefits across the nation. Notably, the specified amount for the purposes of section 4A of the Act has been updated to Eight thousand three hundred and twenty dollars, effective from December 18, 1970. These regulations are subject to change through subordinate instruments, allowing for adjustments and refinements to the administration of retirement benefits as needed.

Key Provisions

The main operative sections of this legislation concern the amendment of the Defence Forces Retirement Benefits Regulations under the Defence Forces Retirement Benefits Act 1948-1970. Specifically, Regulation 7a is repealed and replaced with a new regulation (1). This new regulation specifies an amount of Eight thousand three hundred and twenty dollars for the purposes of section 4a of the Act (1(a)). The amendment takes effect from and including the eighteenth day of December, 1970 (2). These changes are made by the Governor-General in accordance with the advice of the Federal Executive Council and are notified in the Commonwealth Gazette (1). The obligations and requirements imposed by these regulations primarily concern the updating of financial specifications within the Defence Forces Retirement Benefits Regulations. The new regulation 7a sets a specific monetary value that must be adhered to for the purposes outlined in section 4a of the Act. This updated figure ensures that the financial provisions are in line with current economic standards and requirements. There are no explicit provisions in the text regarding offences, penalties, or civil/criminal consequences for breach. However, the importance of the regulation implies that compliance is mandatory. Failure to adhere to the specified amount could potentially lead to legal ramifications, although the exact nature of these consequences is not detailed in the provided text.
