Overview

The Defence Act 1903 was enacted to provide for the administration and regulation of the Australian Defence Force, including matters related to the remuneration and benefits of defence force members. One of its provisions allows for the creation of determinations to address specific issues as they arise within the Defence Force. This particular determination, made under section 52 of the Defence Act 1903 by Bronwyn Kathleen Bishop, the Minister for Defence Industry, Science and Personnel on 8 January 1997, amends the Defence Force (Superannuation)(Productivity Benefit) Determination to adjust the interest calculation factors applicable for certain calendar years. This amendment ensures that interest calculations for superannuation benefits are updated to reflect current economic conditions, thereby maintaining the integrity and fairness of the benefits provided to defence force members. The policy objective of this determination is to ensure that superannuation benefits are accurately calculated and reflect the appropriate interest rates in line with economic changes.

Scope and Application

The Defence Act 1903 Determination No 1 of 1997 applies specifically to amendments concerning the Defence Force (Superannuation)(Productivity Benefit) Determination. This legislative instrument was made by Bronwyn Kathleen Bishop, the Minister for Defence Industry, Science and Personnel, and it pertains to the calculation of interest applicable to certain calendar years, specifically 1997. The determination outlines the specific interest rate factor of 0.0626 for that year, ensuring that the superannuation benefits for defence force personnel are calculated correctly. This legislation impacts defence force members who are entitled to superannuation benefits and those responsible for administering these benefits. The amendment extends to the Commonwealth level, affecting all defence force personnel within Australia. There are no specific exclusions or thresholds mentioned in the text; however, it is implied that the provisions apply universally to all relevant defence force members. The determination also serves to clarify and refine the application of the Defence Act 1903, particularly in relation to superannuation benefits.

Key Provisions

The main operative sections of the Defence Act 1903 Determination No 1 of 1997 under section 52 involve amendments to the Defence Force (Superannuation)(Productivity Benefit) Determination, specifically updating the factors concerned in the calculation of interest applicable in respect of certain calendar years. The amendment, outlined in section 1.1, involves adding a new factor for the year 1997, which is 0.0626, as stated in the schedule (section 3). This amendment is crucial for ensuring the correct calculation of superannuation benefits for members of the Defence Force, as it directly affects the interest rates used in these calculations. The obligations and requirements imposed by this Determination are primarily administrative and technical in nature. The parties involved, which include Defence Force members, their superannuation funds, and the Department of Defence, must adhere to the updated interest rate factors when calculating superannuation benefits. This necessitates that any financial institutions or superannuation funds managing Defence Force pensions incorporate the new rate into their systems and calculations. The Department of Defence, in turn, must ensure that the updated factors are communicated effectively to all relevant stakeholders to facilitate compliance and accurate benefit calculations. Failure to comply with the provisions of this Determination can result in significant consequences, both civil and potentially criminal. While the specific penalties are not detailed in the Determination, breaches of Defence Act provisions can generally lead to legal actions for non-compliance. This may include corrective actions, financial penalties, or even legal proceedings if the breach is deemed severe. The exact nature and severity of the penalties would be determined based on the specifics of the breach and the discretion of the courts or relevant authorities. In summary, this Determination mandates the incorporation of a specific interest rate factor for the year 1997 into the calculation of superannuation benefits for Defence Force members. It places a clear obligation on relevant parties to update their systems and calculations accordingly. Non-compliance with these provisions could result in serious civil and potentially criminal repercussions, underscoring the importance of adhering to the updated factors as stipulated.
