2. The Defence Force (Salaries) Regulations as amended by regulation 1 apply to and in relation to service by—

(a) members of the Navy and of the Army—on or after 28 May 1976; and

(b) members of the Air Force—on or after 27 May 1976.

Overview

The Statutory Rules 1976 No. 136, enacted by the Governor-General of the Commonwealth of Australia, John R. Kerr, on behalf of the Commonwealth of Australia and with the advice of the Federal Executive Council, establish regulations under the Defence Act 1903-1975, the Naval Defence Act 1910-1975, and the Air Force Act 1923-1975. These regulations were introduced to standardise and update the salary structures for members of the Australian Defence Force, ensuring consistency and fairness across the Navy, Army, and Air Force. The regulations were created in response to the need for an updated and comprehensive set of guidelines that reflect changes in roles, responsibilities, and service conditions. They provide a detailed framework for the remuneration of officers and enlisted members, categorised by rank, years of service, and specific roles such as medical officers, chaplains, and trainees, aiming to address discrepancies and provide a transparent system of compensation. These regulations were made to ensure that all members of the Defence Force are compensated appropriately for their service, reflecting their rank, experience, and the specific nature of their duties. The detailed schedules included in these regulations outline the various pay rates for different categories of personnel, ensuring that each member receives remuneration that is commensurate with their level of service and responsibility. By doing so, the regulations aim to maintain morale, efficiency, and retention within the Defence Force, aligning with the broader policy objective of supporting and sustaining a well-equipped and motivated defence force.

Scope and Application

The Defence Force (Salaries) Regulations, made under the Defence Act 1903-1975, the Naval Defence Act 1910-1975, and the Air Force Act 1923-1975, govern the salaries of members of the Australian Defence Force. These Regulations, as amended, apply to members of the Navy, Army, and Air Force who are on or after 27 May 1976. The Regulations set out detailed salary scales for various ranks and positions, including officers and enlisted members, based on factors such as rank, years of service, and specific duties. There are no stated exclusions or thresholds in the text provided. The scope of the Regulations is comprehensive, covering different categories of officers and members with specific conditions and adjustments based on their roles and experience. The application of these Regulations is further extended and detailed through subordinate instruments, which provide additional specifications and updates to the salary scales.

Key Provisions

The key provisions of the Defence Force (Salaries) Regulations, as amended, detail the salary structures for various ranks within the Navy, Army, and Air Force. Regulation 1 updates and replaces the existing schedules with new salary rates for officers at specified ranks (Schedule 1), male officers not specified in Schedule 1 or listed in other schedules (Schedule 2), female officers and male nurses (Schedule 3), officers with special duties (Schedule 4), medical and dental officers (Schedule 5), chaplains (Schedule 6), male members other than officers (Schedule 7), female members other than officers (Schedule 8), and members undergoing training (Schedule 9). Each schedule outlines the annual salary rates based on rank and years of service, providing a comprehensive framework for remuneration within the defence forces. The obligations imposed by these regulations are primarily on the Defence Department to ensure that all eligible members are compensated according to the specified schedules. This includes verifying the rank and years of service of each member to determine their appropriate salary, and making necessary adjustments in payroll systems to reflect these changes. The regulations also require that all members are informed of their updated salary entitlements and that any discrepancies are promptly addressed. For breaches of these regulations, there are no specific offences or penalties outlined in the text. However, non-compliance with these salary regulations could potentially lead to disputes and claims for underpayment, which could result in legal action by affected members. It is also possible that such breaches could lead to administrative penalties or disciplinary actions within the Defence Department. The exact nature and severity of these consequences would depend on the specific circumstances and the policies of the department at the time.
