Overview

Statutory Rules 1975 No. 149, enacted by the Governor-General of Australia, addresses gaps in the Defence Act 1903-1973, the Naval Defence Act 1910-1973, and the Air Force Act 1923-1973 by amending the Defence Force (Salaries) Regulations. These regulations, made under the authority of the respective Acts, aim to adjust the salary schedules for specified ranks within the Defence Forces and introduce a special allowance for senior medical and dental officers. The policy objective of these amendments is to ensure that the remuneration of Defence personnel is aligned with current economic conditions and service requirements. This legislative instrument was issued by the Governor-General, acting on advice from the Executive Council, and aims to provide timely and necessary updates to the Defence Forces' salary structures to reflect the evolving demands of military service.

Scope and Application

The Statutory Rules 1975 No. 149, made under the Defence Act 1903-1973, the Naval Defence Act 1910-1973 and the Air Force Act 1923-1973, provide amendments to the Defence Force (Salaries) Regulations. These regulations primarily concern the salary adjustments for specific ranks within the Australian Defence Force, including Rear Admirals, Major-Generals, Air Vice Marshals, Commodores, Brigadiers, and Air Commodores. The amendments increase their annual rates of salary and introduce a special allowance for Senior Medical and Dental Officers serving in the ranks of Commodore, Brigadier, or Air Commodore during specified periods. The new salary rates and allowances apply retroactively to certain dates in March 1975, ensuring that affected personnel receive the adjusted remuneration from those dates. The regulations extend across the Commonwealth of Australia, applying to all members of the Naval Forces, Military Forces, and Air Force. The rules do not specify exclusions or exemptions but rather establish a clear framework for the remuneration of specified ranks within the Defence Force.

Key Provisions

The primary sections of these regulations primarily concern amendments to salary rates for specific ranks within the Australian Defence Force, as well as the introduction of a special allowance for senior medical and dental officers. Under section 1, the salary rates for Rear Admirals, Major-Generals, and Air Vice Marshals are increased from $23,238 to $25,690 annually. Similarly, under section 2, the salaries for Commodores, Brigadiers, and Air Commodores are increased from $21,417 to $23,760 annually. The special allowance, as detailed in section 4, is payable to medical officers or dental officers who have served in the rank of Commodore, Brigadier, or Air Commodore during a specified period, at a rate of $1,596 per annum. The commencement dates for these amendments, as outlined in section 5, are 21 March 1975 for members of the Naval Forces and Military Forces, and 20 March 1975 for members of the Air Force. The regulations impose clear obligations on the Australian Defence Force and its members. Firstly, they mandate the updated salary rates for Rear Admirals, Major-Generals, Air Vice Marshals, Commodores, Brigadiers, and Air Commodores, as specified in Schedule 1 and Schedule 5. This necessitates that the Defence Force's payroll system be adjusted to reflect these new rates. Secondly, the special allowance for senior medical and dental officers requires the Defence Force to ensure that eligible members receive this additional compensation for service during the prescribed period. This includes verifying the ranks held by the officers and the dates of their service to qualify for the allowance. For breaches of these regulations, the legislation does not explicitly outline specific offences, penalties, or consequences. However, the failure to comply with the mandated salary adjustments or the improper distribution of the special allowance could result in legal consequences under the Defence Act 1903-1973, the Naval Defence Act 1910-1973, or the Air Force Act 1923-1973. Such breaches may lead to disciplinary actions or financial penalties imposed by the Defence Force, as these acts provide the overarching legal framework within which the regulations operate. The specific penalties would depend on the nature and severity of the breach, but could include fines, reprimands, or other disciplinary measures as deemed appropriate by the Defence Force authorities.
